Six of this district’s Court of Appeal held yesterday, in a decision that restores a sentence of life without the possibility of parole for a man convicted under a felony murder theory, that a jury’s special circumstance finding that a defendant had been a major participant in the underlying felony and had acted with reckless indifference to human life is binding on a trial court at resentencing.
