Construction work zone safety is a growing issue as there were approximately 27,900 crashes and 215 fatalities in construction work zones on Texas roads in 2024 and approximately 26,3000 crashes and 192 fatalities in construction work zones in 2023. SB 1366 aims to increase safety for drivers and construction workers by improving driver’s education on this issue.

Senate Bill 1366 (89th Texas Legislature, Regular Session) requires each Driver Education course or Driving Safety course completed on or after September 1, 2026, to include information about Construction or Maintenance Work Zones.

• No later than August 1, 2026, providers must update their curriculum and submit to the department a current curriculum outline to the Online Statement of Assurance application. A separate statement of assurance transaction must be submitted for each driver education provider and driving safety provider license. 

The curriculum must include, at minimum:

• How to safely drive through construction or maintenance work zones; 
• How to identify construction or maintenance zone flaggers and traffic signs;
•  The penalties, fines, and inherent dangers such as bodily injury, death, property damage associated with the violation of traffic laws in construction or maintenance work zones;

Modules:

The following modules must be updated to include the new requirements supporting SB 1366. 

1. Teen Courses: Modules 3 and 6
2. Exclusively for Adult Course: Topic 4.1.7.1
3. Driving Safety Course: Topic 4.2.5.1 or 4.2.8.1

Duplicate Submissions:

Once the provider has submitted the statement of assurance, they will receive an email confirmation and their Versa account will show the application status for the Statement of Assurance as “OPEN”.  There is nothing further that needs to be done, the department will contact you if additional information is needed.
