A covered entity must obtain the individual’s written authorization for any use or disclosure of protected health information that is not for treatment, payment or health care operations or otherwise permitted or required by the Privacy Rule. In addition, each covered entity, with certain exceptions, must provide a notice of its privacy practices. The Privacy Rule requires that the notice contain certain elements. The notice must describe the ways in which the covered entity may use and disclose protected health information, and must make a good faith effort to obtain written acknowledgement from patients of receipt of the privacy practices notice.
Through OfficeSafe’s Privacy Automation Tool, practices can electronically obtain patient authorizations, acknowledgements, and definitive requests to access, and transfer protected health information (PHI). The Office for Civil Rights (OCR) may impose penalties on practices that fail to comply with the HIPAA Privacy Rule. Penalties will vary significantly depending on certain factors, and range from $100 to $50,000 or more, depending on the violation.
