DES MOINES – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.

Clinton County

City of Clinton

Provide a complete air quality construction permit application for all emission points for all sources of emissions to the outside atmosphere associated with the Clinton Regional Water Reclamation Facility and other emission locations within the City; respond to all future DNR inquiries regarding air quality construction permit application(s) within seven business days unless a different length of time is agreed to in writing; and pay a stipulated $1,000 administrative penalty for each untimely response.

Implement updated operational protocols on pre-disposal site inspections, property line verification, and site-specific contingency planning; provide documentation that all field supervisors and project managers have been retrained on the mandatory six-hour notification requirements under Iowa law; and pay a $10,000 administrative penalty.
