Attorney General Tong Announces Antitrust Settlement with Moving and Storage Companies Over Alleged Bid-Rigging
(Hartford, CT) -- Attorney General William Tong today announced a $90,000 settlement with Fallon Moving & Storage, Inc. and Commercial Moving Services, LLC, resolving an investigation initiated earlier this year into illegal bid-rigging on a state contract for moving and storage services in violation of the Connecticut Antitrust Act. The investigation, conducted by the Office of the Attorney General, found that the companies shared sensitive pricing information and pre-coordinated their bids.“Public contracts must be awarded through open and honest competition. When companies coordinate bids instead of competing, it undermines trust and drives up costs for taxpayers. This settlement reaffirms our commitment to fair, competitive bidding and holds these companies accountable to operate with transparency and integrity moving forward,” said Attorney General Tong.
Under the settlement agreement, the two companies were alleged to have harmed competition in the supply of moving and storage services to state agencies and municipalities that rely on bids submitted under the state contract, by engaging in a bid-rigging conspiracy that created a false appearance of competition in violation of federal and state antitrust laws. As a part of the settlement, the two companies agreed to pay the state a collective monetary payment of $22,500, with an additional $67,500 deferred on the condition that the companies fully comply with the terms of the agreement, which requires them to adopt an antitrust compliance program to help ensure that they do not violate the antitrust laws in the future. The companies cooperated with the investigation.
