AN ACT

Amending Title 35 (Health and Safety) of the Pennsylvania

Consolidated Statutes, in Commonwealth services, further

providing for general authority of Governor.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1. Section 7301 of Title 35 of the Pennsylvania

Consolidated Statutes is amended by adding a subsection to read:

§ 7301. General authority of Governor.

(g) Limitations.--When a formal disaster declaration

affecting the Commonwealth is made, the Commonwealth must adopt

the United States Department of Homeland Security Cybersecurity

and Infrastructure Security Agency's Essential Critical

Infrastructure Workers Guidance Version 4.0 to identify the base

level of essential business operations and services. The

Commonwealth may adopt a more broad list of essential business

operations and services than what is included in the Essential

Critical Infrastructure Workers Guidance 4.0.
