AN ACT

Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An

act to consolidate, editorially revise, and codify the public

welfare laws of the Commonwealth," in departmental powers and

duties as to licensing, providing for lifeguards.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1. The act of June 13, 1967 (P.L.31, No.21), known

as the Human Services Code, is amended by adding a section to

read:

Section 1010. Lifeguards.--Notwithstanding any other

provision of law to the contrary, no child care center shall be

required to maintain a certified lifeguard at the child care

center in order to maintain licensure under this article.

Section 2. Any and all regulations at 55 Pa. Code §§

3270.31(e)(4)(iii) and (iv) and 3270.115(a)(6) and (7) and other

provisions of 55 Pa. Code Ch. 3270 are abrogated to the extent

of any inconsistency with this act.

Section 3. This act shall take effect in 60 days.
