AN ACT

Amending Title 53 (Municipalities Generally) of the Pennsylvania

Consolidated Statutes, in preemptions, prohibiting vehicle

locking devices by municipalities.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1. Title 53 of the Pennsylvania Consolidated

Statutes is amended by adding a section to read:

§ 306. Vehicle locking devices by municipalities prohibited.

(a) Preemption.--No municipality may adopt or enforce an

ordinance, resolution, rule or take other action authorizing the

municipality to place locking devices on vehicles in the

municipality.

(b) Definitions.--As used in this section, the following

words and phrases shall have the meanings given to them in this

subsection unless the context clearly indicates otherwise:

"Boot clamp." A device that consists of a clamp designed to

surround the wheel of a vehicle so as to prevent removal of both

the wheel and the device and to prevent the vehicle from being

moved.
