Latest EHS Regulations Updates Assist Companies to Achieve EHS Compliance

This audit protocol, which covers relevant Belgian and European Union (EU) EHS requirements, is an update from the previous version from March 2019. The regulatory date for this release is March 2021.

Regulation (EU) 2019/1021 of the European Parliament and of the Council of 20 June 2019
on Persistent Organic Pollutants repeals and replaces Regulation (EC) No 850/2004 on Persistent Organic Pollutants as of 14 July 2019. This Regulation addresses requirements, restrictions and prohibitions pertaining to the placement on the market and the management of wastes relating to persistent organic pollutants and subject to the Stockholm Convention on Persistent Organic Pollutants. In comparison to the repealed Regulation, it expands and further harmonizes existing requirements.

Decree of 23 December 2011 on the Sustainable Management of Cycles of Materials and Waste was added to incorporate prohibitions on the use and handling of roof and façade cladding that contains asbestos.

Royal Decree of 8 September 2019 Establishing Book 1 on Low Voltage and Very Low Voltage Electrical Installations, Book 2 on High Voltage Electrical Installations and Book 3 on Installations for Transmission and Distribution of Electrical Energy (AREI) was adopted to amend and replace General Regulations of 10 March 1981 on Electrical Installations for Household Installations and Some Lines for Transport and Distribution of Electricity (AREI). In addition to several substantive changes to the requirements, the structure of AREI has also completely changed. It is now divided into 3 "books."

European Agreement Concerning the International Carriage of Dangerous Goods by Road (ADR 2021), 30 September 1957 as amended through 1 January 2021, establishes rules for the movement of dangerous goods by road that are applicable to those European States that have agreed to the ADR (most of the European States/Countries). This 2021 version of the Agreement replaces the 2019 version of the Agreement.

Commission Implementing Regulation (EU) 2020/1435 of 9 October 2020 on the Duties Placed on Registrants to Update Their Registrations under Regulation (EC) No. 1907/2006
of the European Parliament and the Council Concerning the Registration, Evaluation, Authorization and Restriction of Chemicals (REACH) (Commission Implementing Regulation (EU) 2020/1435, OJ L 331 of 9 October 2020 amends Article 22 of REACH. This Regulation introduces chemical registration amendment triggers and deadlines for all types of chemical registration amendments categories listed in Article 22 of REACH, including changes relating to registrants' status, changes in the composition of a substance or its tonnage, new identified uses or uses advised against, new knowledge of the risks to human health, or changes relating to the classification, labeling of a registered substance under Article 22 of REACH.

Regulation (EU) No. 98/2013 of the European Parliament and of the Council of 15 January 2013 was added to this protocol to cover requirements for explosives that have not been covered in this protocol before. This Regulation considers the marketing and use of explosives precursors.
