76 deaths at the Buffalo Psychiatric Center in less than 3 years according to State documents and thousands annually state-wide require federal investigations

It is extremely important to expose and eat this elephant one bite at a time and really digest what is going on behind closed doors in the dark and the web of secrecy and corruption. Let’s start with the first bite being the Buffalo Psychiatric Center.
As Governor Cuomo was in Buffalo doing his political road show, Assemblyman Michael Kearns was exposing the facts regarding staggering numbers of deaths at the Buffalo Psychiatric Center where Cuomo wants to put children. Documents were obtained through FOIL from another State agency operated by the governor. To my understanding falsifying official records are felonies. Buffalo News broke the story which was originally titled, “Kearns asks for Justice Department investigation into deaths at Buffalo Psychiatric Center” which has since been changed to “Lawmakers battle over future of children’s psych center” http://buffalonews.com/2017/04/11/new-wny-childrens-psychiatric-center-buffalo-will-bigger-services-cuomo-says/ .
The same State documents reveal a pattern of massive numbers of deaths occurring within agencies throughout New York State operated or overseen by Governor Cuomo and his administration. The questions are; why are there so many deaths, who is investigating these deaths, are the District Attorney’s and Medical Examiners being notified and why are there no prosecutions? The public call for federal investigations is without question valid and obviously the State of New York cannot investigate itself, although they want to. The internal reporting and investigations is how most negligent deaths are covered-up.
In bulleted points below or bites at this elephant it is important to expose this very ugly death cover-up scheme that was set up by Governor Cuomo and his administration following the award winning New York Times investigative reporting series titled, “Abused and Used” which was a runner up for a Pulitzer Prize http://www.nytimes.com/interactive/nyregion/abused-and-used-series-page.html?_r=1& . Instead of moving to fix major systemic problems leading to all sorts of preventable injuries, crimes and deaths, Governor Cuomo chose to try to continue to hide what is going on behind closed doors.
To stay focused on the deaths there are 11-13 people with disabilities dying within New York State’s extremely dangerous mental health care system on average every day. Yes, you read this correctly; every single day an extremely large number of deaths of people with disabilities are occurring and a large percentage are individuals dying extremely young that have no terminal illness. There are reasons why so many people are dying prematurely and the number one known trend leading to what is internally documented and called “untimely” deaths is bypassing and simply not calling 911 which keeps outside emergency first responder medical and police authorities out of the picture and not notified. In most cases the disabled and those struggling with mental illness have no chance.

• Gov. Cuomo is fully aware of the staggering numbers of deaths of people with disabilities that are occurring in known unsafe facilities throughout New York State that are under his Executive control.
• Gov. Cuomo set up an internal reporting system that violates the rights of the disabled circumventing or bypassing the 911 call systems in place for everyone else. This discriminatory practice according to the NYS Constitution is “Discrimination in civil rights” denying this specific group of people their equal rights to “equal protection of laws.”
• Gov. Cuomo took total control of this agency and called it the Justice Center for the Protection of People with Special Needs (Justice Center) to deceive everyone that was not directly involved in this scheme. This State agency is a fraudulent whitewash cover-up entity that throws a small number of people under the bus to give itself an appearance of legitimacy.
• Gov. Cuomo ensured that mandated reporters would be required by law to report to his agency with no law requiring crimes, medical emergencies or even deaths to be immediately reported to 911 keeping emergency medical and police first responders from being able to respond. Many deaths are due to this specific fact of bypassing 911.
• No 911 call, there is no independently recorded original call at the time of crime, emergency or death which is a key piece of evidence.
• No immediate police response, there is no swift independent criminal investigation, proper evidence collection or retention and no police report for County elected District Attorney’s to prosecute these cases and ensure justice for the disabled.
• No 911 call, there is no independent medical first responder to assist the victim and no independent medical report by an outside authority, and obviously no transportation to a local hospital.
• Gov. Cuomo has set up a system that purposefully bypasses County Elected District Attorney’s and most reported criminal cases to his Justice Center never are reported to County elected District Attorney’s as required by law.
• Gov. Cuomo set up his own “special prosecutor” who is a State employee to bypass County elected District Attorney’s so that most crimes and deaths could easily be covered up.
• Gov. Cuomo’s wrongfully titled Justice Center is directing State and provider agencies to investigate deaths occurring within their own facilities https://www.justicecenter.ny.gov/sites/default/files/documents/JusticeCenterDeathReportingClarification12-17-15.pdf (see number 4).
• The law requires all these deaths to be investigated by County Medical Examiners or Coroners, yet the Justice Center which fields these thousands of deaths annually in most cases never notifies the County Medical Examiner or Coroner. The sole purpose of these illegal actions is to be able to easily cover-up negligent deaths.
• Gov. Cuomo has craftily worked with financial and working parties in what the State of New York itself calls their “coherent oversight scheme” and “carefully cultivated understanding” to protect providers and their employees from litigation.
• Gov. Cuomo ensured that most of the offenders would be protected, not the disabled by changing the level to determine abuse or neglect from “some credible evidence” to a “preponderance of evidence” which is a higher standard of proof.
• Gov. Cuomo ensures that most deaths are never autopsied to determine the true cause of death.
• Gov. Cuomo shut down all independent legal Protection and Advocacy entities previously in place to protect the disabled which had legal authority to go into these facilities at anytime and access all records (Between 16-18 legal entities shut down by Cuomo).
• Gov. Cuomo appoints a person whom worked for him while he was the NYS Attorney General, Timothy Clune, to head up a supposed independent federal watchdog agency. Disability Rights New York (DRNY) works closely with the State to conceal criminally negligent deaths from local authorities and has been complicit. DRNY has refused to ask the U.S, Department of Justice to do criminal and civil rights investigations for over three years with full knowledge of what is going on. DRNY is in on the cover-up scheme.
• Gov. Cuomo has directed Justice Center officials to educate all police agencies throughout New York State, over 560 of them, of the criminal jurisdiction Cuomo’s State agencies have in these criminal cases regarding these people whom I must add are treated as sub human beings. Police agencies are being told by Cuomo’s people to funnel crimes occurring within their jurisdiction to the Justice Center which in turn funnels most back to the facility where the possible crime or criminally negligent death occurred.
• Gov. Cuomo’s Justice Center is regularly violating New York state FOIL laws in attempts to hide and conceal as much damaging information as possible. News reports have documented that all FOIL requests are funneled through the second floor of the Capital or the governor’s attorney’s.
• Gov. Cuomo’s Justice Center has been sued and lost regarding withholding of records of abuse, yet they still disregard a judge’s order.
• Gov. Cuomo’s Justice Center was just audited by the NYS Comptroller who blasted them for obstructing their audit and withholding vast amount of documents from them, including what went to the police or not.
• Gov. Cuomo’s scheme further unravels as his “special prosecutor” has been deemed to be operating unconstitutionally by not being an elected prosecutor.
• Gov. Cuomo’s “special prosecutors” authority in these criminal cases was challenged even by NYS Attorney General Schneiderman.
• Gov. Cuomo’s Justice Center is not a Justice Center, but instead a criminal enterprise regularly obstructing justice by keeping most reported and witnessed crimes, including criminally negligent deaths from local authorities and independent investigations.
• Gov. Cuomo’s scheme is a criminal conspiracy, it is well thought out with distinct motives, which include Medicaid Fraud.
• If it supposedly was not documented, it did not happen, is part of how this death cover-up scheme works.
• Documents obtained through FOIL from dozens of New York State Counties reveal that most crimes and deaths are never reported from Governor Cuomo’s Justice Center to County elected District Attorney’s or Medical Examiners.
• Gov. Cuomo’s Justice Center has no oversight whatsoever and is operating lawlessly.
• Gov. Cuomo has been able to get away with this scheme for as long as he has because all the agencies he controls are trying to protect him and this horrific scheme that surrounds billions of dollars in fraud.

The Buffalo Psychiatric Center is only the tip of the iceberg or only one bite of this giant corrupt elephant. It is because of the extreme level of corruption and the fact that this could not only end the governor’s political career and send him to jail for a long time, his people are doing everything imaginable to try to spin the 76 deaths documented regarding the Buffalo Psychiatric Center into something differently than what is documented. The office of Mental Health (OMH) is operated by Governor Cuomo and so is the Justice Center whom both are disputing the numbers of deaths. Why would Assemblyman Kearns be smeared for simply presenting a State document and for calling for a federal investigation? This obviously is an extremely damaging matter to the governor and he certainly has much to fear. Everything documented can be substantiated through documents and evidence. Emails from Cuomo’s agencies to reporters, which are not evidence or facts, cannot change the sheer numbers of deaths attributed and documented to agencies under the governor’s control. The buffalo Psychiatric Center along with Governor Cuomo, the Justice Center and other top State officials must be investigated by the U.S. Department of Justice and held accountable for numerous federal crimes.
