Pope Francis and New York Governor at Odds Regarding Civil Rights for the Disabled

Pope Francis clearly spoke out recently on the importance of not shunning the disabled as reported in a Newsmax article tiled, “Pope Slams Culture of 'Perfect' People Shunning the Disabled” http://www.newsmax.com/Newsfront/EU-REL-Vatican-Pope/2016/06/12/id/733445/.

New York State and Governor Cuomo specifically continues to ignore the Pope’s call and denies the most basic of civil and “equal rights” for the disabled, the equal privileges to immediate 911 first responder assistance provided all other New York State residents. Mandated reporters are not directed or required by law to immediately call 911 when a disabled person living in a residential facility or group home is a victim of a physical or sexual assault crime or in medical distress. Hard to fathom, this level of discrimination and horrific civil rights violations continues to date, but it does. The discriminatory, extremely dangerous and deadly practice of bypassing 911 call systems in New York State for “this specific group of people” is without question “Shunning the Disabled.” Every attempt to address this severe discrimination problem with Governor Cuomo and his top staff for years have either gone ignored or pushed to the side as if people with disabilities are not worthy of immediate 911 emergency help and services.
When a friend looked up the meaning of the word shun on his phone, this is what came up, “persistently avoid, ignore, or reject (someone or something)”. This is exactly what Pope Francis is saying for us not to do; persistently avoid, ignore, or reject someone, in this case “the Disabled” My son Jonathan was a young New York State resident only 11 at the time when he was severely abused and neglected. Jonathan was developmentally disabled, he had autism and was non-verbal and lived at a private school named the Anderson School, now called the Anderson Center for Autism when he was unlawfully denied food and meals for “behavior modification.” Jonathan was secluded or unlawfully imprisoned for extended periods of time and restrained illegally, he suffered greatly. Jonathan had bruises all over his body. Jonathan was left to lie in his own urine soaked bed when he was blocked in his room and not provided help to the toilet and was ignored.
The State of New York was criminally negligent ignoring Jonathan’s safety and rights even knowing that the Anderson School in the two years prior had 73% of the indicated cases of child abuse and the State of New York looked the other way allowing the child abuse of autistic children to continue http://autismschoolabuse.com/Abuse_at_Anderson_School.html . My precious son Jonathan was simply one of the next victims, and everything was attempted to be covered-up, not just by the Anderson School, but by two State agencies under the Governor’s authority. 911 was never called by any staff, caregivers, nurses or administrators who knew of the abuses, crimes and injuries, and they all are mandated reporters. Anderson staff knew that Jonathan was in dire need of 911emergency help and was a victim of crimes and no one called 911. Jonathan was shunned, Jonathan was ignored and his basic human rights were violated.

The Jonathan Carey Foundation is doing everything humanly possible to assist and empower the disabled community and their families to fight for their basic human rights. It is unbelievable, but true, that in 2016 we would have to fight for the “equal rights” for this forgotten class of people that make up 5-6% of our population, over 15,000,000 Americans. Jonathan is now in heaven, but the fight goes on to protect and save the lives of Jonathan’s friends, which are everyone that has a disability or struggling with mental illness.
Less than two and a half years later, after Jonathan was severely abused, neglected and maltreated and eventually diagnosed with PTSD from the child abuse he suffered, Jonathan now only 13 was killed by his New York State caregivers. Jonathan was suffocated to death and no one immediately called 911. We later found out that multiple suspicious facial injuries that Jonathan sustained, that too were never reported to 911 so local police could respond, happened while Jonathan was in the care of the same man that took his life. This is what devastation can happen when you shun and ignore a disabled person and bypass the emergency 911 call systems, innocent people can and do die prematurely-lots of them.
In New York State alone 11-12 deaths are reported to Governor Cuomo’s established abuse hotline wrongfully named the “Justice Center for the Protection of People with Special Needs” every day on average totaling over 4,000 annually. A sizable number of these deaths are known to be “untimely” and the number one known trend leading to these “untimely” deaths is not calling 911. Most reported deaths to this State agency are never criminally investigated, never reported to County elected District Attorney’s or Medical Examiners or Coroners. Federal authorities must intervene to stop this and hold those involved in the civil rights violations and criminal cover-ups accountable.
New York State and Governor Cuomo are shunning the disabled. As the father of Jonathan and a full time advocate for 1,000,000 New Yorkers with disabilities safety and rights I have fought for over 9 years since Jonathan’s preventable death to finally ensure the same 911 emergency services for the disabled that are in place for everyone else. This year could have been the year, but once again Governor Cuomo ensured that my 911 immediate and direct reporting bill would not get to the floor for a vote, even with a third of the State legislators named on and sponsoring this vital emergency legislation that would save countless lives.
