Plaintiffs Firm Blasted by Judge in Asbestos Case
A judge blasted a well-known plaintiffs firm in an asbestos case.
Mesothelioma Cancer News (Los Angeles) – A judge in Los Angeles had stern words for a well-known plaintiffs firm in an asbestos case. As reported by The National Law Journal, the judge accused the Dallas based firm Waters & Kraus of attempting to force a settlement by filing cases in two separate jurisdictions.
As noted in the report, Waters & Kraus filed a lawsuit on behalf of a man in Los Angeles who passed away from mesothelioma in 2007, first in Texas and subsequently in California. Of their actions, Kraus is said by the Law Journal to have stated they did so in accordance with policies for filing in jurisdictions that allow ailing clients to not have to sit through lengthy depositions.
Alexandra Epand with the Los Angeles asbestos litigation firm Nixon Peabody is quoted as stating of the case, “I definitely think this is something the defense and plaintiff's bar are going to watch very, very closely, and it will have very important ramifications regardless of whichever way it goes.”
