Emergency Department Physician found not responsible for quadruple amputation
Fort Lauderdale, FL (MMD Newswire) January 14, 2009 -- On January 12, 2009, a jury found no liability against an emergency department physician, the emergency department nurses, an internist and a surgeon in a medical malpractice case alleging that these healthcare providers caused a quadruple amputation on a patient suffering from a kidney stone.
James J. Nosich and Marc P. Ganz from McGrane, Nosich & Ganz, P.A., located in Coral Gables, FL defended the emergency department physician in a case where sympathy for the patient was intially thought to be an overriding factor in obtgaining a fair and impartial jury. However, through extensive jury selection, these two lawyers were able to convince the jury to set aside the natural sympathy for this 40 year old mothr of two and focus on the facts of the case.
The trial took approximately 10 weeks and consisted of rigorus cross-examination and a battle of the medical experts. The plaintiffs alleged that the emergency department physician failed to diagnosis a "classic" presentation of a kidney stone which led to septic shock while the patient was still in the emergency department. The plaintiffs further alleged that the emergency department physician failed to properly treat the shock and then provided improper information to the internist over the telephone causing him not to come into the hospital on a timely basis. The plaintiffs went on to say that all negligence by the subsequent treating physicians was causally connected to the emergency department physician since they relyed on the alleged medical mismanagement and wrong diagnosis by the emergency department physician.

Obviously, this case involved catastrophic damages. The plaintiff and her family were brought into the courtroom to testify while experts on her behalf testified as to the significant ecomonic damages associated with quadruple amputations.
The emergency department was defended on the medicine and the simple fact that although the plaintiff suffered from significant damages, her life was saved by the emergency department physician. Significant time was spent in trial by the attorneys for the emergency department physician discussing the disadvantages that plague any emergency department physician when faced with an unusual presentation of an underlying serious medical condition.
