AG Derek Schmidt statement on District Court ruling in <em>Hodes & Nauser v. Norman</em>

KANSAS, December 7 - TOPEKA – (December 7, 2021) – Kansas Attorney General Derek Schmidt today issued the following statement in relation to yesterday’s Shawnee County District Court decision that held a 2011 state statute establishing standards for licensing abortion clinics and a later enactment prohibiting telemedicine abortions to violate the Kansas constitution:

“As we have said since the Kansas Supreme Court proclaimed in 2019 that the state constitution sharply restricts government regulation of abortion services, even reasonable health-and-safety or public-funding limitations are in legal peril in Kansas. We will appeal yesterday's decision to a higher court, but in all likelihood the ultimate judgment will rest with the people of Kansas themselves in the August 2022 public vote on the Value Them Both constitutional amendment.”

Yesterday’s decision was Hodes & Nauser v. Norman, Case No. 2011-CV- 1298, in the District Court of Shawnee County, Kansas.
