DATATRAK Provides an Update on Ongoing Litigation
/EINPresswire.com/ -- CLEVELAND, OH--(Marketwired - November 10, 2015) - DATATRAK International, Inc. (OTCQX: DTRK), the leader in developing cloud-based, unified dClinical
On November 6, 2015, the U.S. District for the Northern District of Ohio issued a ruling granting Medidata's motion to dismiss DATATRAK's action for infringement of U.S. Patent No. 7,464,087 ("the '087 Patent"), which covers systems and methods for unifying data. The ruling found claims of the Patent invalid on the grounds that they are not directed to patentable subject matter, notwithstanding the fact such claims successfully survived a reexamination challenge through a decision of the Board of Patent Appeals and Interferences in 2014. The Court's ruling is based upon the Supreme Court's 2014 decision in Alice Corp. Pty. Ltd. v CLS Bank International, which was issued over three years after the case was filed in 2011. As a result, the Court entered judgment in favor of Medidata in the case without reaching the merits of DATATRAK's infringement contentions.
"We are disappointed in, and strongly disagree with, the Court's analysis in finding the '087 Patent claims invalid and plan to appeal the decision," said Chairman and CEO, Laurence P. Birch.
Mr. Birch continued, "It is important to note that only certain claims of the '087 Patent were at issue in this case and that DATATRAK's patent portfolio includes several other key patents and pending applications. DATATRAK is committed to protecting its intellectual property and, with that goal in mind, we will be evaluating the patents in our portfolio with the benefit of this decision and its reasoning."
