Avoid These Mistakes When Negotiating an Employment Agreement
// Dallas, Texas, United States // Attorney Keith Clouse (Press Release) // Keith Clouse
In legal matters, “do-overs” are rare. That’s why it’s important for an executive negotiating an employment agreement to get it right the first time. Dallas employment lawyer Keith Clouse regularly negotiates employment agreements on behalf of executive clients. He suggests executives avoid these common mistakes when negotiating employment agreements:
1. Rushing. An executive who is anxious to get a deal done may not carefully consider the proposed terms and may not craft an agreement that adequately protects his interests. 2. Relying on oral promises. There should be no side agreements; any important terms should be included in the final written contract. 3. Being unprepared. An executive must identify his deal breakers at the outset. If an executive hasn’t identified his bottom line, he won’t know when to walk away. 4. Being too aggressive. Some points are deal breakers and some are not. An executive should not push back on every proposition. 5. Failing to understand the employer’s perspective. An executive should ask open-ended questions and focus on the answers to “why” questions. Doing so will help him understand the employer’s concerns and help the parties reach an agreement that is mutually beneficial.
