AMA Establishes Principles for Physician Employment

The American Medical Association recently established its AMA Principles for Physician Employment. These guidelines are intended to help physicians and their employers identify and address the unique challenges that are inherent in physician-employer relationships. Keith Clouse, a Dallas employment lawyer who regularly advises physicians on employment-related matters, believes that reviewing these guidelines at the outset of a relationship may help a physician and his employer tailor an employment agreement that fully addresses the parties’ concerns.
The AMA Principles for Physician Employment address six broad topics. These topics include: Addressing Conflicts of Interest; Advocacy for Patients and the Profession; Contracting; Hospital Medical Staff Relations; Peer Review and Performance Evaluations; and Payment Agreements. Subtopics include issues such as an employed physician’s ability to engage in volunteer work, non-compete concerns, a physician’s right to due process before termination for cause, and indemnification for billing for physician services.
In addition to reviewing this guidance, many physicians also opt to hire an attorney to review and negotiate employment agreements.
