Chicago Wrongful Death Lawsuit Filed in Commuter Rail Accident
/EINPresswire.com/ Two railroad operators and a medical center are named in a wrongful death lawsuit recently filed in Cook County, Ill. The suit was filed by the parents of a woman who died after being struck by a train at a station in Deerfield.
“Accidents such as this are usually preventable,” said Chicago personal injury attorney Robert Briskman, who is not involved in the case,, “and always very difficult for surviving family members. Whenever negligence is suspected, it is important for accident victims and survivors to know their legal rights.”
Lauren Marie LeVert, a 29-year-old living in Lake Forest, Ill., was killed in October 2010 when she stepped or fell off a train platform into the path of an oncoming freight train. The Lake County Coroner's office ruled it an accident at that time.
LeVert's parents claim that she had been prescribed medication that caused disorientation and was under the influence of that medication at the time of the accident.
Northeast Illinois Regional Commuter Railroad Corporation operates the Chicago-area commuter railroad known as Metra. That company and the Canadian Pacific Railway Company are each named as defendants in the lawsuit, which claims they acted with negligence in allowing unsafe conditions at the train station.
The third defendant is Rush University Medical Center, where LeVert was prescribed the medication. The suit claims that the hospital was negligent in incorrectly prescribing the medication.
The lawsuit seeks damages of an unspecified amount.
