Costa Concordia Disaster Yields $100M Lawsuit Against Carnival

Chicago, IL — A Costa Concordia crew member has filed a class action-seeking lawsuit against Carnival Corp., the worlds largest cruise-line owners, over the fatal wreck near Italy’s coast, reported Bloomberg.

On January 13, 2012, the Costa Concordia ran aground on rocks off Giglio Island in the Tyrrhenian Sea, which left the cruise-liner half submerged on its side. Sixteen people still remain missing, while 16 others have been pronounced dead.

The captain, Francesco Schettino, has since been accused to navigating the boat too close to shore, and then abandoned ship as it sank with passengers still on board.

The lawsuit, which was filed in a Chicago federal court, alleges negligence and a breach of contract against Carnival Corp., and Miami-based Carnival's Costa Crociere unit in Italy. The lawsuit is seeking class action status for all the victims of the disaster.

The suit is seeking damages for alleged violation of the Athens Convention for safely carrying passengers at sea, breach of contract, negligence, unjust enrichment, and at least $100 million in punitive damages.

Schettino has since been suspended and place under house arrest on January 17.

The case is Lobaton v. Carnival Corp., 12-cv-598, United States District Court, Northern District of Illinois (Chicago).
