House Key Vote: Support H.R. 910 to Stop the EPA Power Grab
Dear Representative,
On behalf of more than 1.7 million Americans for Prosperity activists in all 50 states, I urge you to support measures coming to the House floor this week to prevent the EPA from overstepping its authority by attempting to regulate greenhouse gases (GHGs) under the Clean Air Act. These measures properly restore Congress’s role in making laws and helps to end the job-killing regulatory burdens EPA is currently implementing.
I urge you to vote Yes on H.R. 910, a bill clarifying that the EPA has no authority to regulate greenhouse gases under the Clean Air Act. AFP will rate this vote in our congressional ratings.
The Obama administration’s continued attempt to use a wide range of statutes to regulate GHGs is unacceptable and must be stopped. These are statutes that Congress never contemplated would be used for GHGs and are not designed for climate change policy. Such rulemaking circumvents the legislative process and thwarts the will of the American people. H.R. 910 helps stop this by prohibiting the EPA from using the Clean Air Act to impose new regulations on American businesses.
Hopefully, as this bill moves to the floor, the House will have the opportunity to vote on amendments that expand the scope of H.R. 910 to include other statutes that are being similarly distorted. Just as the Clean Air Act was never designed to regulate GHGs, neither was the National Environmental Policy Act, the Endangered Species Act, or the Clean Water Act. Recent efforts by environmental lawyers to pursue climate change policy through common law tort actions are equally inappropriate. I urge you to support any amendments limiting the Obama administration’s ability to distort any environmental statutes, as well as any amendment prohibiting implementation of climate change policy through judicial common law remedies.
AFP may rate votes on additional amendments that expand H.R. 910’s coverage to protect the original intent of other environmental statutes and prohibit common law tort remedies as well.
