West Virginia woman files mesothelioma lawsuit following asbestos-caused death of her brother

A woman has filed a lawsuit against 65 companies in West Virginia’s Kanawha Circuit Court, alleging that the death of her brother was caused by asbestos-laden products made or used by these companies.

Judith Ann Latorre reported that her brother, Glen E. Kitchen Jr. was diagnosed with mesothelioma on February 22nd and died March 5th. Mr. Kitchen worked for Armco Steel from 1965 until 1986 as a rigger.

Mesothelioma affects less than 3,000 Americans each year, and while there are palliative treatment methods available, including chemo, there is no known cure. The disease typically lies dormant for up to fifty years before an individual begins to suffer from mesothelioma symptoms, and the majority of patients lose their battle with this cancer in less than two years following diagnosis. Exposure to asbestos can also cause other lethal diseases, including asbestosis.

Ms. Latorre says that the corporations showed unforgivable negligence, failed to clean contaminated buildings, and misrepresented the safety of their products/work environments.

According to local news sources, a partial list of the 65 defendants in the suit includes companies such as: 3M Company; A.K. Steel Corporation; A.W. Chesterton; Ajax Magnethermic Corporation; Allied Chemical Corporation; Amdura Corporation; Aurora Pump Company; Bucyrus International, Inc.; Buffalo Pumps, Inc.; Caterpillar, Inc.; Certainteed Corporation; Clark Equipment Company; Cleaver-Brooks Company, Inc.; Columbus McKinnon Corporation; Cooper Industries, LLC; Crane Co.; Dravo Corporation; Eaton Corporation; Elliott Turbo Machinery Company; Flowserve FSD Corporation; Flowserve US, Inc., and its Byron Jackson Division; Flowserve US, Inc.; FMC Corporation; Foseco, Inc.; Foster Wheeler Energy Corporation; Garlock, Inc.; General Electric Company.
