Jury deliberates New York police brutality claim
New York, NY--A U.S. District Court jury in White Plains, New York entered deliberations around 10:30 a.m., Wednesday morning reported the Lower Hudson Valley News. The 12-person jury heard the case, brought against a Yonkers police officer by prosecuting attorneys after a grand jury indictment, related to an incident involving a female patron in a New York City restaurant two years ago.
According to District Court documents, 39 year-old Officer Simoes, a nine-year veteran with the Yonkers police department, is accused of body slamming 44 year-old, Irma Marquez, onto the floor of La Fonda Restaurant on March 3, 2007. Prosecuting attorneys played a surveillance video from the Palisade Avenue restaurant for the jury outlining the alleged beating, which they claim broke Marquez's jaw and caused her to suffer a concussion.
Criminal defense attorneys representing the New York police officer, accused of beating the woman, assert the officer slipped on a wet floor and dropped Marquez. Personal injury lawyers representing Marquez filed an $11 million lawsuit against Simoes and the city in federal court a few weeks after a Yonkers City Court jury cleared her of criminal charges. Marquez was charged with disorderly conduct and obstructing governmental procedure and found innocent on both misdemeanor counts.
