San Marcos, California (MMD Newswire) March 17, 2009 -- Business owners of Liberty Tax Service, located at 817 W. San Marcos Blvd, were notified by citation that the City of San Marcos will prohibit holding "free tax service" community signage at the corner of San Marcos Blvd. and Bent Ave. in the City of San Marcos.

Liberty Tax Service greets San Marcos commuters on San Marcos Blvd. in colorfully dressed patriotic costumes of Uncle Sam and Statue of Liberty waving at drivers passing by their San Marcos Blvd. location. The patriotic "wavers" have been holding signage communicating "free tax preparation" for community service employees, such as teachers, firefighters, police officials, medical workers, military, and non-profit volunteers. Liberty Tax Service also commonly does free tax preparation for seniors in the community.

On Friday the 13th of March, the same day many teachers are receiving pink slips due to budget cuts, City of San Marcos code enforcement officers issued a citation to the patriotic wavers stating that the sign holding violates the San Marcos Municipal Code Section 20.120. "The signage does not have any commercial insignia or logo and only communicates "free tax preparation" to the community service workers", says Alan L. Geraci, General Manager of the Liberty Tax franchise. Geraci adds, "During the month of March each year, we reach out to the community and try to apprciate community service workers like teachers and firefighters who give so much to our community."

Geraci says, "We have been trying to cooperate with the City, but they have no reasonable boundaries. Our marketing plan only covers tax filing season and is friendly, colorful, unobtrusive and welcomed by the community." Geraci plans to appeal the citation.
