Rodriguez' nomination must be confirmed by the Commission on Judicial Appointments, a process that can take several months. If Newsom is recalled in the Sept. 14 election, it's ulikely the commission could hold a confirmation hearing fast enough to prevent a new governor from rescinding the nomination, if he or she chose to do so.
