Commission closes anti-dumping investigation into Argentinian and Indonesian biodiesel, anti-subsidy investigation continues

The Commission today closed its investigation into the dumping of biodiesel from Argentina and Indonesia. This decision concerns an old case that was re-opened in order to bring the applied methodology into line with EU and World Trade Organisation (WTO) rules.

In 2016, the EU General Court ruled that the measures that the EU imposed in 2013 were not lawful. They were also found to be incompatible with WTO law. The EU takes its legal and international commitments very seriously. Therefore, the Commission revisited the investigation from the point where the problematic methodology was introduced. After weighing up all the evidence carefully, the Commission has decided to stop the investigation because of insufficient proof that the injury suffered by the EU biodiesel industry in the period originally investigated (2012-2013) had been caused by dumped imports from Indonesia and Argentina.

Meanwhile, a separate investigation into the use of subsidies by the Argentinian government in the same sector is still ongoing. The deadline for definitive measures in this process is 27 February 2019.
