Luanda, ANGOLA, June 8 - The implementation of local governments in gradual processes, as outlined in the Angolan Constitution, is related to its territorial application and not the functional one, said last Thursday in Luanda the constitutionalist Raul Araújo. ,

The university lecturer and expert in constitutional law spoke to ANGOP in the launching of the didactic work entitled “Constituição da República de Angola Anotada” (Constitution of the Republic of Angola with explanatory footnotes) Volume II, co-authored by Raul Araújo, the university lecturers Elisa Rangel and Marcy Lopes.

 

“To me, this discussion (on gradualism) does not make much sense from the academic standpoint. (...) there are experiences of various countries which show that when gradualism is mentioned it means territorial”, Raul Araújo defended.

 

He went on to explain that the functional gradualism is the one that lingers in time, a slow process based on the transfer of state functions (central govt) to the local governments.   

 

“Portugal has local governments for many years now, and currently it is analysing the transfer of state competences to the local governments, at the level of issues linked to teaching, education and health”.  

 

The Constitution of the Republic of Angola outlines, in article 242, that the implementation of local governments must obey the Gradualism Principle.  

 

In view of this, the government defends territorial gradualism in the implementation of local governments in Angola, at an experimental stage, which means some municipalities will be selected for the first local elections scheduled for the year 2020.

 

In regard to this issue, the opposition parties advocate that the gradualism mentioned in the Constitution is functional (gradual transfer of competences) and not territorial, thus, they defend that the first local elections should not leave out any of the existing municipalities.
