Court papers filed by Plaintiff Nutrition Distribution allege that Dr. Huge has publicly acknowledged he is a founder, and that Sacramento, Calif.-based Enhanced Athlete has confessed that Dr. Huge controls the company's social media.
"Mr. Hughes told the Sacramento Business Journal that he was going to come to my office and confront me, now he is nowhere to be found,” said Los Angeles Attorney Robert Tauler, a principal of Tauler-Smith LLP, who filed the lawsuits on behalf of Nutrition Distribution LLC, a Phoenix-based maker natural sports supplements. "Mr. Hughes is under investigation by the state bar and I understand that there is an ongoing criminal investigation taking place regarding his company, so I understand his reluctance to come to U.S. soil, but according to the law, he does not have a choice."
A Sacramento judge on Thursday will decide whether to compel Hughes to make himself available to be deposed.
Enhanced Athlete has been the subject of public scrutiny since Nutrition Distribution served the defendants in September. In October the company’s business in the United Kingdom was raided by food safety investigators who seized a large amount of DNP, which was extensively covered by The Guardian. The drug, a pesticide and herbicide, has killed several people in the U.K. who have taken the drug as a shortcut for weight loss; it is illegal to sell for human consumption. The same month, The Wall Street Journal published an expose of Enhanced Athlete’s business practices.
The FDA raided their facilities on Dec. 6, and YouTube terminated Enhanced Athlete’s YouTube marketing and promotion channel on Dec. 22 for violating community standards. Since that time Enhanced Athlete has lost affiliates and credit card processing services, according to court documents.
