WTO Issues a Report on EU Compliance with Airbus Case Ruling

Dispute settlement | Brussels, 22 September 2016

The WTO today issued the compliance panel report in the Airbus case between the EU and the US.

The panel rejected new US claims that the repayable support for the airbus models A350 XWB and A380 are 'prohibited subsidies', which is an important win for the EU. The panel has also found that all previous repayable support to other aircrafts, such as the A320, had ended.

But there are certain findings of the panel that we consider to be unsatisfactory. We are still analysing the detail of the report. Under the WTO Dispute Settlement Understanding, the EU and the US have the right to appeal.

Also, it is important to read the findings of today's report in its larger context. Two other WTO rulings are expected in the coming months as regards US subsidies for Boeing. One similar proceeding regarding the compliance of the US with the previous WTO ruling concerning Boeing (DS 353) and an additional case on massive subsidies to Boeing from the State of Washington (DS 487).
