Wills are important legal documents. Surprisingly, many British Columbians still pass on without one, which can lead to numerous complications in estate management. The minimum age for completing a will used to be nineteen, but under the new Wills, Estates and Succession Act ("WESA") the requirement has been lowered to 16.

The blog explains that section 36 of WESA states "a person who is 16 years of age or older and who is mentally capable of doing so may make a will." However, a will made by a person under 16 is not valid.

"This is significant because WESA now allows for minors, people under the legal age of majority (19), to make a will," says a representative from Kushner Law Group.

It should be noted, however, that wills require the signature of two witnesses who must be 19 or older.

"Everyone should have a will to protect their families. While a lawyer is not required for the will making process, hiring one provides considerable peace of mind that your will is both binding and enforceable."
