Resigning From a Job: Doing it Right

// Dallas, Texas, United States // Attorney Keith Clouse (Blog) // Keith Clouse

An executive who lands a new job may immediately turn his attention to the new venture and neglect important details regarding his departure from his current employer. Keith Clouse, a Dallas employment lawyer who advises executives in job transitions, believes an executive must carefully orchestrate his departure.

Most importantly, the executive needs to fully understand his obligations to his current employer and how those obligations impact the new employment opportunity. A key consideration is the executive’s existing non-compete obligations. Other considerations include the conditions of resignation (such as a 60 day notice requirement) and if any penalties attach when the executive leaves before the end of his contract period.

Once the executive is ready to move forward, he should draft a written resignation letter. Then, he should arrange a face-to-face meeting with his supervisor. During the meeting, he can hand the supervisor the letter. Depending on whether the relationship is friendly or strained, the executive may wish to discuss the specifics of the new opportunity himself or refer all questions to his lawyer.
