Being Pressed to Retire Early? Asks Executive Employment Lawyer Keith Clouse

Many senior executives love their work. Some plan to keep at it until they can no longer physically handle it. Others have an age or date in mind when they would like to retire. But, unfortunately, in a down economy, the choice of when to retire is not always the executive’s to make. Far too many senior executives find themselves forced into retirement earlier than they would like.

An executive who has been “asked” to retire should meet with employment law counsel right away. It’s unlikely that the lawyer will be able to save the executive’s job, but the lawyer could be instrumental in helping the executive evaluate his options and negotiate a favorable exit package. For example, the lawyer could negotiate a package that includes a retirement benefit to offset the penalty of retiring early, continued health benefits, or job search assistance. Or, perhaps the parties can agree that the executive will remain with the company for a transitional time as a consultant or that he will be able to use office space and secretarial services for job search purposes.
