Departing Employees, Avoid Being Accused of Trade Secret Theft

In today’s technology-based world, an executive who leaves a company may be unjustly accused of trade secret theft. An executive should avoid doing anything that would put him at risk of such an accusation. Keith Clouse, a Dallas employment lawyer who represents executives in all types of employment matters, suggests that an executive do the follow:

• When working from home, use a company laptop and log in remotely (instead of emailing files to a personal email account or copying files to a thumb drive). Doing so keeps everything on the company’s server and minimizes the potential for accusations that the executive planned to share documents with his new employer.

• Let someone know if you plan to take hard-copy files home. That way, you cannot be accused of “sneaking” files out.

• Do not take any documents with you when you leave unless you have express permission. In most cases, an employer will not want an executive to take anything.
