About the Case
On December 8, 2021, National Merchants Association, Inc., a California corporation, (“NMA” or “Plaintiff”) filed a seven-count suit against Commercial Bank of California, a California chartered bank, in the Superior Court of California, Los Angeles County, California, case number 21STCV44674, for, among other state and federal violations, breach of written agreement, breach of covenant of good faith and fair dealing, unjust enrichment, and unfair business practices (the “Complaint”).
In the Complaint, the Plaintiff maintains that the Defendant, among other issues, grossly and negligently mishandled Plaintiff’s funds and confidential information, engaged in deceptive business practices to the severe detriment of NMA, and wrongfully withholding funds and fees owed to NMA.
This is likely the first of many such actions against the mismanaged bank.
