NY Attorney General Eric Schneiderman Ignoring Civil Rights of the Disabled
AG Schneiderman is taking decisive actions regarding voting rights, but refuses to take vital actions to protect the disabled or ensure their most basic rights
It is critical for the Jonathan Carey Foundation www.jonathancareyfoundation.org to bring to light and to the attention of the general public that close to 7,000 calls are reported to a fraudulently operated New York State abuse hotline for the disabled on average every month. The physical, sexual and psychological abuse, neglect, maltreatment and deaths occurring in New York State run and privately operated provider facilities and group homes are astronomical in scope. The New York State mental health care system as a whole is extremely dangerous and deadly as evidenced by the sheer numbers as reported on NYS documents. These crimes and the even greater crimes regarding the purposeful cover-ups of most criminal matters must be stopped. All of our appeals for emergency help for the disabled to New York State Attorney General Schneiderman to stop the wide-scale discrimination in civil rights and criminal cover-ups are ignored. It is as if the disabled are not considered average residents of New York State and their rights do not count or matter. Our New York State and U.S. Constitution clearly states differently.
This is what is going on in New York State, upwards of 1,000,000 individuals with disabilities are in direct danger of severe harm or death due to the fact that if they are a victim of a physical or sexual assault crime, have been significantly been injured, in medical distress or have stopped breathing mandated reporters are not required by law to call 911. Instead, in most of these emergency situations such as witnessed physical and sexual assault crimes and deaths the New York State agency, wrongfully titled the Justice Center for the Protection of People with Special Needs (Justice Center), is required by law to be called. This is obviously not about protecting people with disabilities safety, health, rights or lives, but about protecting negligent agencies and staff that harm or cause the death of our most vulnerable. We have 911 emergency call systems, first responder medical and police personnel and local courts throughout New York State Counties to assist everyone and ensure justice for all, but in most cases they are purposefully bypassed for the disabled.
I will explain how the New York State scheme works. When a disabled person is need of emergency help, instead of calling 911 mandated reporters are directed by law to call the State Justice Center which is not a first responder entity, nor are they independent. No 911 call by mandated reporters and witnesses there is no initial recorded 911 call and documented official evidence to an outside independent entity. No 911 call by mandated reporters and witnesses there is no immediate response by local police or emergency medical personnel. No 911 call by mandated reporters and witnesses there is no independent medical or police reports generated which are critical pieces of evidence to hold the perpetrators accountable. No 911 call by mandated reporters and witnesses there is no independent criminal investigation, appropriate evidence collection and retention, victim and witness written statements, photographs, DNA etc., etc. No 911 call by mandated reporters and witnesses in most cases there is no reporting of the reported crimes to County elected District Attorney’s. If a disabled person living outside of their family’s homes stopped breathing and no mandated reporter or witness calls 911 the disabled person has little to no chance of being revived. Then in most death cases regarding a disabled person in New York State that number in the hundreds every month, County Medical Examiners and County Coroners are not being notified by the Justice Center. Obviously, when this happens these officials cannot respond to the scene of the death and do their job, which is to do an onsite investigation, speak with witnesses, file an initial written report, take possession of the body and do an autopsy to determine the true cause of death.
In New York State almost all deaths which rise to the level of criminal negligence, which are staggering numbers are purposefully covered-up. New York State Attorney General Schneiderman and his office are aware of these crimes occurring and the illegal and discriminatory practices by top State officials. Attorney General Schneiderman has chosen to protect the State and individuals involved in multiple State and federal crimes, instead of the disabled. The direct conflict of interest that Attorney General Schneiderman has is that he is supposed to represent the people of New York State, which is to include the disabled, but at the same time he legally represents the State and State officials and employees. Requests for a Independent Special Prosecutor to be appointed years ago now were ignored by AG Schneiderman and our requests for him to seek immediate federal criminal and civil rights investigations also have gone ignored, unless he has done something recently secretly unbeknownst to us.
The discrimination that continues against people with disabilities in New York State is extremely disturbing, it is illegal, it is extremely dangerous and deadly. The discrimination in civil rights occurring throughout New York State is the direct cause for many severe injuries and deaths and it is unconscionable. It is hard to fathom that over 50 years have passed since Dr. Martin Luther King Jr. fought against similar injustices and wide-scale discrimination for a different and less vulnerable group of people. It is hard to fathom that New York State continues to treat the disabled as a lower class citizens denying them in most cases their basic right to 911 emergency services and their equal protection of laws. Everyone knows that if 911 is not called in an emergency medical situation there is a very high likelihood the person in need could die. Everyone knows if local authorities such as local police, District Attorney’s, Medical Examiners and Coroners and local courts are bypassed there is no chance for equal protection of laws or justice.
