New ABA books offer insights into botnet, cybersecurity research
CHICAGO, Aug. 20, 2013 — With cyberattacks growing in frequency and sophistication, two new books from expert Jody B. Westby offer those in the field new tools to guide them through issues associated with legal research as well as resources to deal with the legal and policy intricacies of botnets and other malware.
Both books are from ABA Publishing in conjunction with the ABA Section of Science Technology Law. Together, they serve researchers, institutional review boards, legal counsel and others as helpful handbooks to determine whether a particular research project could violate laws or organizational policies.
Legal Guide to Cybersecurity Research focuses primarily on new ways to better manage risks associated with the use of network communications datasets in cybersecurity research and development. For instance, laws governing the interception, disclosure and use of network communications data are strict, confusing and carry criminal penalties. The book will help guide practitioners through this legal framework. It will also help them to know whether network communications data may be lawfully obtained and used in RD projects; whether privacy laws, legal obligations or organizational policies preclude usage of the data or require that certain aspects of the data be made anonymous or eliminated; and what measures can be taken to protect against legal and policy problems in cybersecurity RD.
Legal Guide to Botnet Research serves as a central resource to advance understanding of legal and policy issues associated with cybersecurity research on botnets, a collection of Internet-connected computers that have had software secretly installed that allows a remote controller or hacker to issue commands. Included in the guide is the Botnet Research Legal Template, which helps clarify which laws are relevant to a particular project and simplifies the required analysis. The book also highlights potential ethical issues in this area.
In both books, author Westby of Washington, D.C., draws from a unique combination of more than 20 years of technical, legal, policy and business experience. She now provides global consulting and legal services to public and private-sector clients in the areas of privacy, security, cybercrime, breach management and informational technology governance. She also serves as adjunct professor to the Georgia Institute of Technology’s School of Computer Science and is Adjunct Distinguished Fellow to Carnegie Mellon CyLab, and a blogger for Forbes online magazine.
