Texas Resident Files Asbestos Lawsuit Following Diagnosis of Asbestos Illness

A Texas man and his wife have filed an asbestos lawsuit that names 18 corporations as defendants. The suit claims that the man, Gilbert L. Harper, developed an asbestos-related disease because of the actions taken by these 18 companies.

Asbestos exposure may cause mesothelioma, lung cancer, pleural plaques, or For Harper and his wife, Bonita, this is the second lawsuit filed by them. This newest suit was filed because the Harper’s are now claiming a different asbestos-related health claim than was listed in their previous complaint.

Harper claims he has suffered “great physical pain and mental anguish, has incurred medical costs, suffers from a physical impairment and suffered a progressive loss of earning capacity”, according to the complaint.

Named as defendants in the suit were A.O. Smith Corporation, A.W. Chesterton Company, Babcock Borsig Power, CBS Corporation, Certainteed Corporation, Cleaver Brooks Inc., Crane Co., Crown Cork and Seal Company, General Refractors Company, Garlock, Georgia Pacific, Goulds Pumps, Ingersoll Rand, Kelly Moore Paint Co., Pneumo Abex Corporation, Sepco Corp. and Zurn Industries.

Mr. Harper worked as a painter, plumber, carpenter, and fire investigator over the course of his working life. He also did some work related to heating and air conditioning. Mr. Harper alleges that while on these various jobs, he was exposed to asbestos-laden materials.

Harper contends that the defendants were negligent, and failed to test their asbestos-containing products that they were selling, and failed to warn Harper in a timely manner of the dangers of asbestos exposure. Harper also alleges that the companies furthered their negligence by continuing to manufacture and sell their asbestos-laden products.
