NOVI, Mich., Feb. 7, 2012 /PRNewswire/ -- During a ceremony today at the National Biodiesel Conference in Orlando, Hino Trucks was recognized by the National Biodiesel Board with the 2012 "Eye on Biodiesel Impact Award."

The "I-Awards" represent the biodiesel industry's top honors, and are bestowed upon companies, groups or individuals who have helped carry the biodiesel torch, fostering understanding, mentoring others and encouraging broader use of this cleaner burning, sustainable fuel. Hino Trucks was nominated for an award this year for serving as a trailblazer among manufacturers as well as among hybrid truck manufacturers in supporting the use of B20 biodiesel blends.

Hino Trucks was honored in the Impact category by becoming the first manufacturer to support the use of B20 biodiesel blends in a hybrid-electric truck, as well as in its complete product line of class 6 and 7 conventional trucks. Not only will Hino's COE 195h hybrid truck be a part of the event's Biodiesel Vehicle Showcase, but Hino was invited to be a part of a general session OEM panel entitled "The Future is Unwritten: Energy Policy, Diesel Technology, and B20" as well as the technical session discussing "Biodiesel Engines of Today and the Future – Development of Super High Efficiency Diesel Engines."

All 2011 and later model conventional trucks powered exclusively with Hino's proprietary J-Series engines are approved to use B20 biodiesel blends that contain biofuel blend stock (B100) compliant to American Society for Testing and Materials (ASTM) D6751, and blended fuel compliant to ASTM D975. B20 biodiesel meeting these standards is also approved for use in Hino's newly announced diesel and diesel-electric hybrid cab overs due to enter the market late this summer.

Cell phone owners may have a new use for their favorite device. In addition to providing access to a host of applications for staying in touch with friends, tracking weather, playing games, shopping and keeping tabs on our expenses, your cell phone now may be able to help you avoid a DUI. Recently, several developers have created applications designed to tell users when they have had too much alcohol to operate a motor vehicle. It remains to be seen if the application is accurate or reliable enough to be of any use.

How It Works

The app is based on a common field sobriety test known as the horizontal gaze nystagmus (HGN) test. Alcohol in the bloodstream causes people to suffer alcohol gaze nystagmus (AGN). This form of nystagmus shows up as a jerking movement of the eye as it moves from looking straight ahead to looking to the side. The cell phone app takes pictures of the eye as it moves to determine whether or not you are over the legal limit of 0.08 to drive in Illinois.

While the creators claim their application has scientific backing, critics are concerned that individuals who do not understand how to administer the test cannot possibly rely on the results to make such an important decision. They warn that a person who is impaired by alcohol is unlikely to make the right decision based on a cell phone application. As always, you should use good judgment and find a designated driver rather than risk facing Illinois' stiff DUI penalties.

Breath, blood and urine tests are considered the best evidence of blood alcohol content. Of the commonly administered field sobriety tests, the HGN test could be considered the least unreliable option. Concerns about the HGN test generally center on whether it is administered properly, as inexperience, inattention or impatience can lead even a trained officer to make a mistake. There are several forms of nystagmus that are not related to alcohol consumption. It is not clear if the application can distinguish those forms of nystagmus from AGN. Despite the potential drawbacks, the creation of an accurate detector of intoxication could go a long way toward preventing accidents and deaths related to driving under the influence.

No matter how advanced an application is, if you ever question whether you are capable of safely operating a vehicle after consuming alcohol, it is always better to find a someone sober to do the driving. A DUI arrest and conviction can land you in jail, cost you your license and lead to thousands of dollars in fines and other expenses. If you find yourself facing a DUI charge, you will need to use that cell phone to call an experienced attorney to defend you in court.

Series of Bus Accidents Provides Wake-Up Call About Driver Fatigue

A string of recent bus accidents has highlighted the dangers of driver fatigue.

February 03, 2012 /24-7PressRelease/ -- The past year has been one of tragic accidents in the intercity bus industry. There was a string of fatal bus crashes across the county. These bus accidents have shed light on the issue of driver fatigue and the long hours bus drivers spend behind the wheel.

The National Transportation Safety Board (NTSB) was commissioned to comprehensively study the discount bus industry and applicable safety regulations, and the agency recently released its findings.

The Problem of Bus Driver Fatigue

The expanding curbside bus industry provides economical transportation for passengers, but this is sometimes at the expense of safety. Some company policies allow and even encourage drivers to work with little sleep. Many drivers are paid such low wages they need to work long hours, sometimes over 100 a week, to make an adequate income. When they do receive time to rest, the sleeping conditions are sometimes cramped or unsanitary.

Gaps and loopholes in regulations have allowed the discount bus industry to operate largely under the radar. For instance, bus drivers don't earn overtime pay because intercity bus operators are exempted from Fair Labor Standards Act (FLSA) overtime rules.

Driver Fatigue a Major Cause of Bus Accidents

The NTSB found "driver fatigue as a contributing factor to fatal motorcoach accidents and has identified driver fatigue as an issue on its Most Wanted List of Safety Improvements." The report also explained that the industry requires increased oversight and enforcement.

According to the NTSB estimates, 36 percent of motorcoach collision deaths during the past 10 years have been caused by driver fatigue. This makes driver fatigue by far the leading cause of deadly bus accidents. Other causes like inattention and road conditions each make up less than 10 percent.

Congress is also focusing on improving bus safety through regulations addressing the structural integrity of buses and the implementation of other safety technologies. Although such measures may be valuable, they don't directly address the issue of driver fatigue which appears to be the root cause of most fatal accidents.

Hopefully, the increased attention the issue of bus driver fatigue has received will lead to more effective regulations and enforcement leading to improvements in the industry.

Supreme Court Addresses GPS Tracking and the Fourth Amendment

The U.S. Supreme Court decision in U.S. v. Jones addressed whether police needed a warrant to use GPS devices to track a suspect's movements. The answer? Yes.

February 03, 2012 /24-7PressRelease/ -- The issue of whether police need a warrant to use a Global Positioning System (GPS) device to track the movements of a person suspected of criminal activity has divided the nation's appellate courts. Some courts said "yes"; some courts said "no."

The U.S. Supreme Court recently decided that "yes" is the correct answer in U.S. v. Jones. In a unanimous decision, the judges said that law enforcement must obtain search warrants before using GPS devices to track an individual's movements. This decision could have a profound impact on those facing criminal charges.

Background of U.S. v. Jones

Antoine Jones managed a nightclub in Washington, D.C. and police suspected him of dealing drugs. Police placed a GPS device on Jones' car while it was on private property, without his knowledge or consent. Law enforcement officials monitored Jones' movements for approximately four weeks with the GPS device, generating and storing over 2,000 pages of data about Jones' location.

Police eventually arrested Jones for conspiracy and possession with intent to distribute cocaine. Jones went to trial and objected to the admission of the GPS data because police did not have a warrant. Jones argued that using a GPS device constitutes a search for the purposes of the Fourth Amendment and the police needed a warrant based on probable cause to do so. The court allowed the GPS data into evidence. A jury found Jones guilty and he appealed.

The Appellate Court's Decision

The U.S. Court of Appeals for the District of Columbia Circuit agreed with Jones that using a GPS device to monitor a person's movements 24 hours a day for a month is a search under the Fourth Amendment. The court rejected the analogies that the government tried to make to other cases where the court found it acceptable to monitor suspects' movements if they were in public or if police used radio beepers, reasoning that such "point to point" observation is different than the constant monitoring that GPS data provides.

The government appealed the appellate court's decision to the U.S. Supreme Court.

The U.S. Supreme Court's GPS Decision

According to Supreme Court Justice Antonin Scalia, who wrote the majority opinion in U.S. v. Jones, attaching a GPS device to Jones' jeep "encroached on a protected area," and was therefore a search. The search violated the Fourth Amendment's protection against unreasonable search and seizure.

The Supreme Court's decision could have a significant impact on how police are allowed to monitor those they suspect of crimes -- particularly those whom they believe to be committing drug offenses. The decision comes at a time when police officers are increasingly relying on technology to collect information on criminal suspects -- whether or not they are allowed to do so by law. This is the first U.S. Supreme Court decision to apply the Fourth Amendment to new forms of surveillance technology.
