UK Government Lifts Ban On Gay Men's Blood Donation. Or Does It?

/EINPresswire.com/ Gay men's health writer Dr George Forgan-Smith explores the implications of the lifting of donation of blood by gay men. Will this change in law lead to change or is is merely a way of placating the equality movement.

While the lifting of the ban on homosexual males donating blood in the UK has been heralded as a strong step towards reduced discrimination, Dr George Forgan-Smith, gay men's health writer and editor of The Healthy Bear, examines the changes in law and questions if it will make a difference at all.

"While the change is certainly welcomed, it would appear that the stipulation that gay men who wish to donate blood must not have had sex, both protected and unprotected, for 12 months is not only draconian but makes donation of blood by gay men next to impossible."

While most blood born pathogens can be rapidly tested on donated blood, hepatitis B proves to have a prolonged incubation periods of up to 12 months where it can remain undetected. The legislated request for gay men to abstain from oral and anal sexual practices for 12 months represents the hope to avoid hepatitis B infected blood from entering the donated blood pool.

While gay and other men who have sex with men have a high representation of hepatitis B infection in the community this is not uniformly applied to all homosexual males. Indeed there are many gay men living in monogamous long term relationships who would be proud to donate blood however these laws exclude their ability to do so.

In his review of how the new laws will be applied Dr Forgan-Smith questions how gay men living in stable partnerships are viewed as different from their heterosexual counterparts.

"Given that there are effective immunisations now available to prevent hepatitis B infection, surely there must be some flexibility in the law that allows homosexual men who are fully vaccinated to have this extended period free of sex to be reduced. WIth the window periods of pathogens like HIV and hepatitis C being at their longest 3 months, and majority of first world countries using advanced testing able to detect viral particles waiting periods in gay men immune to hepatitis B could be potentially reduced to two to four weeks."

"Given the risk of hepatitis B is also high in particular sectors of the heterosexual community I have to wonder why gay males have been singled out for deferred ability to donate blood. If heterosexuals where asked to refrain from sex for 12 months before being able to donate blood the blood stores world wide would be dangerously low within days."

While Dr Forgan-Smith understands that there does need to be regulation of the donation of blood from particular sectors of the community, by writing the post "UK Lifts Ban on Gay Blood Donations, Or Does It?" he hopes to open conversation that not all gay men are alike and the importance of review, consultation and consideration of previous immunisations are vital steps to increasing equity in the live saving act of donating of blood.

In New York, the honeymoon has just started for same-sex newlyweds. For these same-sex couples, champagne, bonhomie and the express good will of friends are the icing on the cake after their decades-long push for gay equality in New York. However, financial and legal experts say same-sex couples are poised to deal with a myriad of new issues when it comes time to make difficult life decisions, as the Federal government doesn't officially recognize same-sex marriages.

Death and taxes doubly certain for same-sex couples

Newlyweds in New York will be able to file their taxes in New York State as jointly or married. Only one of the pair can claim head of household for Federal Taxes, but neither can claim married. And that's just where the problems start, say experts.

New York issues tax returns based on what the
Federal Government grants the filer. In other words, in order to get a New York tax return, one has to have a Federal income tax return. As legally married in New York, and unrecognized at the Federal level, this presents a massive bureaucratic headache, but one that tax-services are remedying through extra-legal means.

In order to surmount this tax-filing conundrum, couples have to file their official tax return as 'unmarried' with the Federal government and then file an unofficial, dummy Federal tax return as married. Only in this way can same-sex newlyweds in New York State supersede the Federal Government's alternative tax code.

Because the IRS, by law, must follow the Defense of Marriage Act, same-sex couples will have to indicate why their state and Federal marital status is different.

LGBT activist say legal disparity costly and speaks to pervasive inequality
In the eyes of the gay community and many same-sex partners, these Federal-state legal disparities within the tax code speak to deeper, pervasive inequality and are the real heart of the LGBT Civil Rights Campaign. Under New York law, same-sex partners are financially and legally equal. Once accountants and lawyers cross the fence into Federal territory, compound legal matters become expensive and murky. LGBT activist are pushing for full financial equality, which they believe is apropos unconditional social equality for gays and lesbians.

In sickness and in wealth

Because the Federal Government does not recognize same-sex marriages, spousal insurance is taxed as employee income. Same-sex couples cannot collect on their spouse's social security benefits and do not have any legal right to their spouse's retirement account.

When a spouse inherits an individual retirement account—an IRA—they cannot capitalize on fringe benefits, like delaying distributions and tax-deferred compounding, or other financial advantages heterosexual couples are allowed. Financial experts in and outside of the gay community have indicated this could lead to huge net losses for same-sex couples. What's more, they say, IRAs are essentially designed to be nest eggs, so if one partner is the primary breadwinner, the other stands to be in the poor house at his or her partner's death.

There are more than a few stories of longtime partners abandoning the wedding aisle at the 11th hour because they were unaware of the financial obligations married couples have. The words in sickness and in health have legal resonance, too: married couples are financially bound by law to support a spouse if he or she falls on hardship like job loss, illness or disability. This possibility of onerous emotional and financial burden resulting from illness or accident has lead some same-sex couples to reconsider walking down the aisle.

Philadelphia Area College students pour out their talents to bring "The Tea Man" movie to a boil!

"The Tea Man" is a quick paced story set near the end of the Cold War when cell phones were car phones and any respectable bank robber still used a big gun. Two life-long mid-life crisis friends decide to rob banks and with the help of an "old head" who had 25 years in prison to think about how to get it right, what could possibly go wrong?

Philadelphia Real Estate Broker and Ex-Marine Joe Carlin found a unique way to get through a down market. He made a movie!

Carlin, 50, said after countless attempts at trying to get his work looked at he decided to do it himself and with the help of some of the most creative minds in the Philadelphia Metropolitan area he was able to bring his story to life. He took a class in January 2010 at the historic Walnut Street Theater and it steam-rolled from there. Several of his classmates also appear in the film.

Even my former business partner Chiu Cheng of Ken Shin Diner on the corner of 3rd & Spring Garden Street not only had a part in the film but was an official site supporter! Like I said, all the excitement begins with a great story."

White House Takes on Anti-Gay Bullying Issue

Nov. 2, 2010 /EIN Presswire/ - After the number of American teen suicides has dramatically increased in recent months due to discrimination against gays, the Obama Administration is launching a nationwide campaign to decrease the amount of bullying in schools.

An education assistant secretary for civil rights said that part of the campaign is to make high school and university students aware of the serious legal consequences for harassment and violating civil rights, especially for sexual orientation discrimination. President Obama said that it is time to end bullying as a "rite of passage" and that harsher punishment in schools would be enforced during his administration.

Additionally, the US Department of Education wants to strengthen prosecution and awareness of other discriminatory practices, such as a recent string of anti-semitic acts in schools.

US Military Accepts Gay Applicants

Oct 20, 2010 /EIN Presswire/ - In the wake of last month's decision in favor of allowing gays in the military, Judge Virginia Phillips refused the government's request for a stay in the ruling. With this reversal of the "don't ask, don't tell" policy intact, the Pentagon ordered recruiters to not deny applications based on a person's sexuality.

Although the federal government plans to appeal the ruling in San Francisco appellate court, the Obama administration has promised to move the law forward ending "don't ask, don't tell" during the lame duck session of Congress following next month's midterm elections.

The military warns applicants and current service members that this new reversal in policy could be overturned at any time, allowing the military to discriminate against openly gay members in the future. Religious Freedom At Stake If Don't Ask Don't Tell Repealed

/EINPresswire.com/ Monsey, NY - May 27, 2010 -- Orthodox Jews will be among religious leaders and pro-family activists converging on Washington DC today to protest the latest efforts to hastily repeal Don't Ask Don't Tell in the House of Representatives. Chief among their concerns are the ways that changes in the armed services rules would seriously compromise religious liberty for military chaplains and religious servicemembers.

In civilian life religious counselors have been punished for not counseling same-sex couples, religious chaplains have been penalized for refusing to allow open homosexuals to lead prayer ceremonies and religious groups have been attacked for not allowing their premises to be used for same-sex commitment ceremonies. In the military where breaches in discipline carry strict penalties the threat to religious freedom is even greater than in civilian life. If the armed services affirm open homosexuality this would inevitably seriously limit the ability of chaplains to preach, counsel and lead services in accordance with their religion and conscience.

Until this week legislation on Don't Ask Don't Tell was waiting for a thorough Pentagon review that is in the process of surveying the opinions of 300,000 servicemen and women, and will be complete in December of this year. However this week with only days notice the White House and some congressional leaders ignored warnings from the Chiefs of the various armed services to move prematurely and they proposed amendments to the 2011 National Defense Authorization Act (NDAA) for immediate congressional vote.

Morale in the United States armed services has throughout its history been rooted in a strong commitment to morality, discipline and the Biblical values shared by many faith communities. These latest moves to undermine the voices of servicemen and women, the majority of whom are opposed to changes in the law, are seen by some religious leaders as another attempt to marginalize and persecute those who adhere to traditional American values.

Some Orthodox Rabbis are particularly disappointed with the role of Senator Joseph Lieberman who wrote the amendment for the Senate armed services committee. Senator Lieberman has frequently described himself as an "observant Jew" and they find it particularly ironic that a self-described religious man would be responsible for threatening religious freedoms.

Rabbi Leiter of Torah Jews for Decency, a pro-family Orthodox Jewish group observes that since its founding, the United States has in both peace and war put its trust in God. "If we want God to protect the men and women serving in active duty we must do what we can to insist that Congress does not undermine morality in our armed services. The spiritual and physical wellbeing of the United States has always been directly dependent on our commitment to morality. I am afraid of what may happen to us if there is any change in the law".

Congress, President Obama Poised to End Don't-Ask, Don't-Tell

Is Kagan Friend or Foe of Gay Marriage?

May 11, 2010 - Supreme Court nominee Elena Kagan has publicly criticized the US military's Don't Ask, Don't Tell policy as discriminatory as an employment policy, but on a similar gay rights issue, the solicitor general has been publicly less supportive of gay marriage.

In 2009 during her confirmation hearing to become solicitor general, Kagan was very succinct about gay marriage, telling Sen. John Cornyn, "There is no federal constitutional right to same-sex marriage."

But the question being raised by conservative groups is if Kagan was merely restating the law in her answer or giving her opinion on the subject. The president of the National Organization for Marriage, Brian Brown, made a preemptive strike Monday, sending out an email that read "a vote for Elana (sic) Kagan is a vote to impose gay marriage on all 50 states."
