Here the details based on documents. <br> <br> Makor Company has purchased in 1970 a large tract of land in Har Homa (Jabal Abu Ghneim) in Jerusalem from its owners. Makor Company wanted to develop residential housing on theirs portion and leave Palestinian owners to build on theirs. The company even planned to build on theirs land a Peace Center where people of different religions and nationalities could work together toward a peaceful relationship. In 1989, Makor and the Jerusalem Development Authority (JDA) (fully control by the government and the municipality) signed an agreement on developing the residential quarter. The JDA submitted zoning plans to the Jerusalem District Planning Committee (JDPC) before expropriation. Makor was sure that their vision was close to be realized. <br> <br> However, the ILA rescinded the agreement between Makor and JDA, the zoning plans submitted to JDPC and confiscated in 1991 all Makor and Palestinian land, claiming that it needed to develop a larger area for immediate security reason. Such claim was false because during the last 20 Years the ILA sold to contractors only land purchase by Makor. As stated on one of Makor's websites, harhoma.com, "The question has never been to build or not to build. The question is should the owners build, or should the land be expropriated and given to government-designated builders. In 1991 the Government of Israel made use of Land Expropriation Law 1943, which is intended for land expropriations for public purposes, such as military bases, hospitals, etc. The law was not intended for seizing lands from enterprise companies…." <br> Makor, the Palestinians land owners and Pease Now Movement, protest the confiscation and suggest to leave each owner to build on his land. No doubted that the confiscation trampled cooperation between Israeli Jews and Palestinians who were ready to live side by side. The result is that the Israeli government ignored advantages to leave the land owners to develop the quarter and causing a huge international uproar and eliciting Palestinian. <br> After the expropriation became final Makor present a claim for just compensation. Makor brought thirteen expert witnesses - among them: prof. Zvi Eckstein, Deputy Governor of the Bank of Israel, Prof. Israel Zang, Vice Rector of Tel Aviv University, Prof Shemuel Zamir of Hebrew Univercity, prof. Shemuel Kandel from Tel Aviv University and architect Prof. Ram Carmi, Israel Prize Laureate, who testifided on the nature of Makor land and on the planning he and his team prepare and submit to JDPC, four appraisals and economists - who appraised the land at $600 per square meter. Judge Danziger ignores the contract with JDA and all thirteen experts of Makor. He rejects the appeal despite the fact that six Supreme Judges decided that Makor has presented plans to build a neighborhood and despite the fact that ILA declared that Makor has had an advantage comparing with neighbors land. He rejects the appeal based on one government employee witness who valued it at $25 per square meter. He compare parcel of 200 square meter with Makor parcel of 800,000 square meter; and ignore that the ILA leased an agriculture land near Makor land for $1,800 per square meter. He didn't use other valuation approaches. <br> <br> Makor found out that Judge Danziger had his own dispute with the same ILA, at the same time, in the same court about land that he leased from ILA. The ILA cancel the lease and Danziger ask for compensation estimated $20 million. <br> <br> Danziger Knew that the probability to win his appeal was very low after his case was totally rejected by the Tel-Aviv district court. By rejecting Makor's appeal for $320 million he expects to receive in return from ILA compensate estimated $20 million. The judge Danziger failed to recuse himself from Makor's case even though he himself had a similar dispute and case pending against the same ILA. <br> <br> Makor, by prof. in law, Berachyahu Lifshitz from Jerusalem Hebrew University, appealed to Dorit Beinish, President of the Supreme Court, alleging bias by Justice Danziger, and asked her to void the verdict. Beinish ruled against Makor, stating - based on Danziger comment - "The proceedings of the appeal before me and the matter to which Judge Danziger is a party have no relationship, let alone the kind of relationship that may found a fear of partiality." But the law and the Israeli Code of Ethics for Judges passed by beinish on 2007 require recusal when the judge has a substantial financial or personal interest in "a party to the proceedings." <br> <br> Makor present a criminal complaint to the General Attorney Yehuda Vienstein again Judge Danziger. Danziger conflict of interest damages the integrity of the Israeli legal system unless it will be investigated by the police to arrive to decision if he commits a crime when he abuse maliciously his power as Judge and sit in case when he has finance interest in the opposite party. In less severe cases it was considered - not only as conflict of interest and breach of trust - but also as bribe. In those cases public servants were charged and found guilty by the Israel Supreme court. <br> <br> Israel prides itself on being a country of justice. Prof. Aharon Barak, former President of Israel Supreme Court state: "…the judge has neither sword nor purse…". Today, given the precedent established by Judge Danziger, everyone can say without hesitation that the Israel Supreme Judge has a purse and also a sword. Judge appropriate measures are not pure anymore, wherever they were stained with a judge's financial interests in a party. His behavior affected the judge's integrity. The prosecution's duty is to require a judge to respect the law and certain principles. If the crime was committed, to prosecute him. <br> <br> No such precedent was found where a judge sat in court and writes judgment when he has financial interest and/or has a dispute with one of the parties. Judge Danziger precedent destroys the Israeli judicial system built in 60 years and presents it as the most dishonest, dangerous, crooked and corrupt legal system of any developed nation. Many Israeli layers encourage Makor to fight against Judge conflict of interest buy refuse to represent Makor for obvious reason. Makor hope that the international institutes that fight corruption will interfere and will not remain indifferent. Makor believe that the world will be watching to see if Israeli authorities correct this apparent miscarriage of justice and restore the Israeli judiciary. <br> <br> The present complaint is related to the investigation already began against Judge Danziger by the police according to permission received from the Attorney General. The issue takes on an entirely new profile---but don't expect it to go away. Not for a while. The Republican opposition will continue to test both its politics and its constitutionality. The politics likely will be settled this year. The court challenges? Who knows.<br /> <br /> The final hours of debate in the House brought into sharp focus these two parallel narratives ---political and substantive---that over the past year of debate often seemed so diffuse and muddled.<br /> <br /> The partisan politics flew out of the box early. Before the measure had even been considered in any congressional committee North Carolina Senator Jim DeMint exhorted Republicans to oppose it on the grounds that it would be President Obama's "Waterloo," weakening him for the remainder of his term in office. It was hardly a subtle way to kick off the debate, and had little to do with substance. How could it? There wasn't yet a line of substance on paper.<br /> <br /> That set the tone for much of what followed. Congressional Republicans quickly became invested in regimenting their troops to enforce total opposition. Visions of 1994 danced in their heads. Solid Republican resistance to President Clinton's health care reform efforts had helped bring on the 1994 GOP takeover of both houses of Congress. Why wouldn't the same strategy work again?<br /> <br /> In retrospect, President Obama's hands-across-the-aisle quest for bi-partisanship seems so quaint. It was never reciprocated in the House. In the Senate, tedious negotiations with Republican Senators Grassley, Enzi and Snowe killed whatever momentum existed for finishing the bill while the Democrats still had 60 Senate votes.<br /> <br /> For Republicans, polls showing increasing opposition to the bill were like political catnip. They got very heady with each new taste, each new pundit column seeming to confirm that total resistance was a wildly successful political strategy this year, as it was in 1994.<br /> <br /> With delicious irony, the very week that the Democrats managed to pull health reform across the finish line the widely read (in political circles) National Journal featured Senate Minority Leader Mitch McConnell and House Minority Leader John Boehner on its cover with this headline: "Movin' On Up? John Boeher and Mitch McConnell discuss the prospect of Republican control." The story began: "Measuring for curtains?......"<br /> <br /> On the night of the final vote partisanship was under full throttle. Democrats cheered Democratic speakers. Republicans cheered Republicans. There was one House, but two teams. Nearly every Republican marched to the microphone to repeat, almost word for word, "I ask unanimous consent to revise and extend my remarks in opposition to this flawed health care bill. " It wasn't enough for Republicans to vote against it. Each had to stand up and call it "flawed," for those watching on C-Span. What discipline!<br /> <br /> Just think of it. All of those Republican members, representing urban and rural areas, rich and poor districts, every region in the country----and not a one of them could see any merit in a bill that mirrored the one Mitt Romney presided over in Massachusetts, and not unlike the one Richard Nixon proposed 35+ years ago. Why? Because to kill the bill would be President Obama's Waterloo. That was the politics of it.<br /> <br /> But there was another narrative, and it was just as important. For many Republicans, the substantive differences were very real and deeply felt.<br /> <br /> Wisconsin Congressman Paul Ryan, one the House Republicans' rising stars, gave an impassioned closing speech that framed the health bill as a defining expression of what kind of country America is and will be.<br /> <br /> America has been built on personal self-reliance, not "paternalism," thundered Ryan. To turn health care into a right managed by the state is foreign to who we are and compromises everything we've become through our history of unique individualism.<br /> <br /> Boehner and minority whip Eric Cantor, another Republican star, echoed that theme. Both were genuinely moved by what they felt to be a horrendous departure from the nation's self-reliant past. Boehner sees this as nothing less than an "apocalypse" for America.<br /> <br /> In expressing these views they were channeling the feelings of tea party protesters and many other concerned Americans. The substantive opposition saw the health reform proposal as 1984, not 1994. For Boehner and many House Republicans, there was no space between substance and politics. They anguished over the prospect of 1984 Big Brother, while at the time relishing what they believed would be the 1994-like political opportunity in November.<br /> <br /> But how much of a departure is the new health care act for America? As Democratic Majority Leader Steny Hoyer said in his closing argument, if Republicans really believe the new health act is a government takeover of health care, to be consistent they should offer proposals to repeal Medicare. Medicare, after all, is a government program. Everyone pays taxes into it. The government handles all the money, sets all the rules and rates and pays all the bills.<br /> <br /> There were dozens of speeches Sunday night about missed opportunities for bi-partisanship. Perhaps the biggest missed opportunity of all was that the Republicans didn't try to improve the health care system when they had both the White House and both houses of Congress. Democrats rarely move in lockstep. Surely some would have supported a Republican proposal.<br /> <br /> Republicans missed the opportunity to reform health care their way. The substance of reform got away from them. And it's possible, maybe even likely, that before the year is over the politics will have eluded them as well. Not Likely. <br /> <br /> March 8, 2010<br /> <br /> By Joe Rothstein<br /> Editor, EINNEWS.COM<br /> <br /> Current political commentary has it that voters will flee from the Democrats this year driven by fears that Democrats are spending too much and are too inclined to exercise government control over a myriad of areas best left to the private markets.<br /> <br /> A corollary to that theory is that the Democratic base will sit this one out, disappointed that the big majorities they helped to elect in 2008 haven't delivered on the promises of progressive change.<br /> <br /> All that could happen. But five bucks says it won't.<br /> <br /> For that to happen non-partisan, independent voters would have to see the Republicans as a better alternative. For most, the Republicans would have to be convincing as a party that seems better able to govern and take care of the country's most pressing problems----like jobs, and health costs. The Republicans would have to grab the political center, where most independents and moderates live.<br /> <br /> But none of that is happening. Instead, Republicans are putting on their fright wigs and scampering to the far right just as fast as their speeches, congressional votes and public appearances will take them there. In their effort to harness the runaway tea party movement, they are embedding themselves on the scary right, leaving the center wide open for the Democrats to recapture.<br /> <br /> We're not talking fringe Republicans here. Virtually the entire Republican House leadership lined up, hat in hand, to woo delegates to the recent Conservative Political Action Committee conference in Washington, D.C., a conference notable for its theme that American freedom is in danger and that extreme measures are needed to save it.<br /> <br /> CPAC's keynote speaker was Fox commentator Glenn Beck who used the occasion to denounce Teddy Roosevelt (that's right---Teddy Roosevelt, not Teddy Kennedy) for starting the progressive movement. Included among CPAC's sponsors were the John Birch Society and the Oath Keepers, a militia group organized to militarily combat what it sees as the U.S. government's plans to declare martial law and disarm the citizenry.<br /> <br /> Into this group marched House Minority Leader John Boehner, talking "revolution," a theme he's been pushing since the first tea partier screamed "I want my country back" last summer. Republican leaders Eric Cantor and Mike Pence were there, trying to outdo each other with one liners about the dangers facing America because of the Democrats. Newt Gingrich, as usual, trumped them all. He packaged everyone's fears into a perceived "Secular Socialist Machine," that he said posed the greatest threat to America he's ever known.<br /> <br /> This is the language of people who see the opposition as mortal enemies, not political opponents.<br /> <br /> To raise campaign money, the Republican National Committee produced a 72-page Powerpoint presentation designed to capitalize on this theme. Before it could go to the party's heavy financial hitters, the Powerpoint found its way out of a Florida hotel room and into the light of day. Once exposed, the odor got too intense for even the party's chairman Michael Steele.<br /> <br /> But it's far too late into the 2010 campaign season for Steele or anyone to redirect the GOP's veer toward the hard right. There's an old Indian saying that "He who rides the tiger sometimes winds up inside." Boehner and his Republicans grabbed onto the tea party tiger last summer and now it's carrying them to places they might want to go.<br /> <br /> The more GOP leaders play ball with their fringe extremists, the more tension they raise in the primaries between experienced, mainstream conservatives and tea party outriders. Worst of all for the Republicans, the primary contests and congressional GOP intransigence as naysayers will do nothing to assure voters that the GOP is a better governing alternative than the Democrats.<br /> <br /> Ray Blunt, a long-time GOP House leader, is desperately trying to curry favor with the hard right in Missouri to fend off a bunch of rivals for Missouri's U.S. Senate nomination. Governor Charlie Crist, who looked like a cinch to hold a Florida U.S. Senate seat for the Republicans might well loose the nomination to a right wing opponent who in turn will lose the political center to a Democrat.<br /> <br /> The Republicans lost their Pennsylvania Senate seat when Arlen Specter saw a political tsunami coming at him from his state's far right. The far right is disenchanted with Rob Portman in Ohio, who once had a virtual lock on that state's Senate seat for the GOP. The same is true in Delaware with Mike Castle and Illinois with Mark Kirk.<br /> It could well be the far right Republican voters who stay home on election day and withhold votes from what they see as centrist candidates.<br /> <br /> And the threat from the right is having another impact: It's stirring the unhappy left into action.<br /> <br /> The coalitions and grass roots workers who made the current Democratic majority possible may no longer believe that helping the Democrats will answer their prayers for health reform, energy reform, massive job programs and withdrawal from Iraq and Afghanistan. But they do know they don't want the Tea Party Right getting its hands on the levers of government. That's plenty of incentive to rouse them from their funk and bring them out to the streets again.<br /> <br /> Elections in the U.S., for better or worse, almost always come down to a choice between two people, one a Democrat, one a Republican. In most congressional districts it isn't a fair fight. The fix is in. Friendly apportionment committees have seen to it that Republicans and Democrats have such a head start in terms of party registration that they have to be convicted ax murderers to lose.<br /> <br /> But there are other districts, maybe 100 of the 435 in all, where the strength of the candidate and his or her party's "brand" makes a difference. These are not districts that go readily for political extremists or extremism. Calls to reason count for more than calls for revolution. These districts may be swayed by arguments that the Democrats are on the wrong track, but not by claims that they are enemies of the state.<br /> <br /> The Republicans have a clear shot at a lot of these districts. At least they would have a clear shot if they offered reasonable alternatives to acknowledged problems. But defined by their votes as the party of "no," talking about "revolution" and tolerating noisy extremist foot soldiers isn't a formula for success.<br /> <br /> No matter what the polls say now, my $5 bucks says that by Halloween the Republicans will look scarier than the Democrats as a political party worth trusting with the reins of power. According to the Times, the letters, obtained through the Freedom of Information Act, "expose the gulf between lawmakers' public criticism of the overall stimulus package and their private lobbying for projects close to home."<br /> <br /> In a letter to Agriculture Secretary Tom Vilsack, Missouri Sen. But the people were more hopeful. Turn that thought around. Today the economic situation is vastly improved, but the people are more despairing.<br /> <br /> What happened to hope and trust? Can it be recovered?<br /> <br /> -----<br /> <br /> Mixed signals tonight from the House and Senate members gathered to hear the President. Inside the House chamber, not evident to the TV audience, clucks and catcalls bubble up from the Republican side of the aisle with some frequency during the speech. Not "you lie," but audible and churlish. These folks don't appear to be buying the bi-partisanship the President is trying to sell.<br /> <br /> More evidence. Republicans largely sit on their hands and cans during most of the President's applause lines. Even when he celebrates tax cuts. Even when he urges an increase in taxes on big banks to pay for the bailouts---which you'd think would be popular given the public's pitchfork level anger at the big banks. Even when the President proposes to eliminate capital gains taxes on small business---a long cherished GOP goal.<br /> <br /> But…..the Republicans are on their feet when the President exhorts Congress not to give up on health reform. Since congressional Republicans so far have been locked in a death grip to derail health reform, how do you explain that? A promising omen?<br /> <br /> -----<br /> <br /> Other thoughts:<br /> <br /> The President's words were direct and powerful, his delivery masterful. But you don't talk a stuck truck out of the muck and mire, and a good speech is not likely to move his agenda. It's frustrating and embarrassing that Democrats haven't been able to enact the big stuff with their big Senate and House majorities. What will change this year? More direct presidential involvement in negotiations? Harry Reid stepping down as Senate leader to focus on his reelection campaign and yielding the post to Dick Durbin, a much tougher cookie?<br /> <br /> In 2009 the President and the Democrats managed to get stem cell research back on track, strike a blow for equal pay for women, place a strong new advocate on the Supreme Court, kick start some major initiatives in education and green energy, restore America's leadership role in the world, vastly improve openness and transparency of government operations and government records, all while staving off a second great economic depression.<br /> <br /> Not a bad year's work, but hardly any of it has generated thank you notes from the public. Instead, public trust and confidence continued to ooze from what should have been a winning team. And this team wasn't playing the Yankees. The Republican answer to most everything was "no." When it wasn't "no" the Republican alternative was an evil twin to the Bush policies of tax cuts and rampant deregulation that resulted in huge deficits and economic collapse.<br /> <br /> As the President correctly pointed out, he inherited a $10 trillion deficit before he walked through the door of the White House, the legacy of two wars, two tax cuts, a big new Medicare drug program and an economic meltdown.<br /> <br /> It shouldn't have been all that hard for the Democrats to get things done and to get some serious credit for it. But last year's strategies didn't connect with the public. Beyond making speeches, what does the President do now? Fire a few of his political coaches and bring in new management? Will we see a new strategy from the old team----or a whole new team?<br /> <br /> -----<br /> <br /> The media's been focusing on those "is the nation on the right track" numbers which are hovering around the mid 30% range. Not great, to be sure. But during Bush's second term those numbers bounced between the teens and the twenties. In October 2008, only 7% thought the country was on the right track.<br /> <br /> It's way too early for anyone to be relegating this President and this Congress to the political scrapheap. What we are seeing is deep disappointment. Many saw a modern political savior when they voted for Obama. That's a view he didn't do a lot to discourage. Tonight, having failed to deliver instant salvation, the President essentially abdicated the savior role and admitted that to accomplish great goals it takes a village: a lot of other public officials, a lot of engaged citizens and a media that doesn't spend most of its time diddling with the trivial.<br /> <br /> -----<br /> <br /> While the halo may be gone, the President tonight reminded those who elected him that he remains Obama the Good Guy. Obama the Articulate. Obama the Embodiment of America's Highest Shared Values And Instincts. He certainly didn't look, sound or feel like a danger to the republic.<br /> <br /> Most Americans still like Barack Obama. The question for 2010 is whether, despite the setbacks of 2009, he has it in him to still be the nation's positive change agent.
