OAIN: Florida Auto Insurance Reform Bill Would Drastically Affect Coverage

A bill that was approved by a subcommittee on Wednesday would replace PIP with "emergency care coverage."

/EINPresswire.com/A bill aimed at reducing fraud and car coverage costs that was approved on Wednesday by a Florida House subcommittee would fundamentally alter what is covered by minimum policies in the state, reports Online Auto Insurance News.

The legislation would completely eliminate the requirement for Florida motorists to purchase personal injury protection (PIP) policies and would instead require them to buy "emergency care coverage" (ECC), a new kind of policy that the authors of the bill have created and is not currently available in any state.

Under ECC, Florida car insurance companies would only be required to pay for emergency medical services that are provided in hospital emergency rooms or hospital-licensed clinics. It would also only provide coverage if people covered under the policies went in for treatment within 72 hours of the crash. If a condition is diagnosed during that period, further emergency care after the 72-hour period would also be covered.

But "if you're referred with a nonemergency condition," said the bill's author, Rep. Jim Boyd, in a subcommittee meeting on Wednesday, further treatment "is not applicable under this policy."

That is a vast change from the current PIP system, which covers at least "80 percent of all reasonable medical expenses" incurred by a policyholder after a crash, up to the policy limits.

If the bill is passed as is and ECC becomes the new standard, Florida motorists would have to purchase optional medical payments coverage or a standard health coverage policy in order to have their non-emergency medical expenses covered.

The authors of the bill want to change the current system because they say unscrupulous medical care providers are overtreating and inflating bills in order get as much as they can of the $10,000 worth of PIP insurance that Florida drivers are required to carry.

Rep. Boyd and an official from the state insurance department said at Wednesday's meeting that replacing PIP with ECC would cut costs for insurers and consumers. They could not say how much costs would be cut, though, since ECC is basically a new type of policy that has never been priced before.

OAIN: NJ Auto Insurance Legislation Could Affect Pricing, Lawsuit Options

/EINPresswire.com/ New Jersey legislators have introduced more than a dozen bills related to car insurance this session, reports Online Auto Insurance News.

About seven pieces of legislation introduced to the New Jersey Legislature this session could have implications for insurers' pricing practices and the situations in which policyholders can sue after an accident, according to Online Auto Insurance News.

At least five of the bills would alter laws regarding how providers of auto insurance in New Jersey approve customers for coverage and set their prices.

Two of the bills would limit the amount of information insurers could use in this process.

One would bar them from taking into consideration any negative driving events that took place while the motorist was driving for volunteer purposes. (That would include things like the unpaid transportation of goods for a nonprofit company.)

The other would stop insurance providers from using—and even asking about—applicants' education level and occupation to help gauge the risk that they pose.

A separate bill would simply require insurers to notify policyholders if their education level and occupation negatively affected their rating.

Another bill affecting pricing practices would officially allow insurers to use data—"such as vehicle speed, mileage, brake application, engine throttle and seat belt usage"—collected from telematics devices to help set rates.

The final pricing-related bill would affect the cost of coverage indirectly. Assembly Bill 902 would boost the at-fault accident threshold from $500 to $1,000. That means smaller accidents may be less likely to show up on a New Jersey resident's driving history, which could help keep coverage costs lower.

Two bills would affect how the state's limited-lawsuit option works. Motorists in New Jersey have the choice of having a limited or unlimited right to sue at-fault drivers for noneconomic damages (like pain and suffering). Those who choose the limited right to sue can get a price break of 30 percent, on average, and can still sue in a handful of situations.

One bill would expand those situations to include accidents in which the at-fault driver was convicted of driving under the influence.

The other would slightly narrow the situations in which limited-lawsuit policyholders could sue. Currently, policyholders with this option can still sue if their accident results in permanent injury. But this bill would limit that to only permanent injuries that cause "a serious life impact" to the person permanently injured.

OAI: Virginia's Unusual Auto Insurance Law Highlighted by Recent Reports

Recent news reports that Virginia motorists are being wrongly ticketed for failure to provide proof of insurance highlight the state's unusual laws governing vehicle coverage—and the wisdom of just buying a policy and keeping your insurance card handy, according to Online Auto Insurance (OAI).

Virginia law does not mandate that drivers carry proof that they are insured. In fact, the Old Dominion State allows some motorists with relatively clean driving records and enough experience to forgo vehicle coverage and instead pay the state Department of Vehicles a $500 fee.

The state is one of only a few in which motorists may either opt to prove they have sufficient assets to cover the cost of an accident or pay a relatively low fee that does not provide coverage but allows motorists to hit the road at their own risk.

According to The Associated Press reports, however, some Virginia drivers are being cited for failing to show proof of coverage, with one motorist in Sussex County being slapped with $110 in fines and court costs earlier this year.

OAI advises drivers to sidestep the hassle and expense of fighting a ticket—even if it's for a violation that does not actually exist—by buying a policy that will allow them to prove they are insured during a traffic stop.

Drivers opting to pay the $500 fee to go uninsured are basically handing over money to be liable for the damages they cause in a crash. On the other hand, motorists with relatively clean records could pay around that much to get a policy and the peace of mind that comes with knowing that one's assets are protected.

OAI advises drivers in Virginia and elsewhere to not only buy vehicle coverage, but to talk to their agent or insurer about supplementing their policies with enough optional coverage to properly protect them in the event of a serious accident.

Last week's announcement that the West Virginia attorney general is suing Liberty Mutual and a body shop for its repair practices highlights the need for consumers to know their rights before taking their cars into the shop, according to Online Auto Insurance.

According to the office of West Virginia Attorney General Darrell McGraw, Liberty Mutual and a West Virginia body shop allegedly employed a repair policy that violated a state law mandating what types of parts can be used to repair vehicles.

State law in West Virginia says that smaller and top rated auto insurance companies alike cannot require policyholders to use non-OEM or aftermarket parts—those made by someone other than the original manufacturer—in repairs if they are being done within three years of its manufacture date.

In addition, body shops must use parts that were made by the original manufacturer in repairs, unless the car owner gives them permission otherwise.

But the attorney general says these two parties used "junkyard parts" to repair vehicles without notification or the policyholders' consent, which crosses a legal line.

Though the issue may seem insignificant to policyholders outside of West Virginia, the majority of states have similar consumer protections in place, and they could be worth researching before taking a vehicle in for repairs.

According to the Connecticut Office of Legislative Research, more than half of states require repair estimates to include notification if aftermarket parts are going to be used, and at least six require the customer's consent before using or requiring the use of aftermarket parts.
