Since the tragic death of Jonathan Carey on February 15, 2007 New York State has done almost everything imaginable to attempt to conceal the staggering scope of wide-scale physical and sexual abuse, neglect and deaths more than ever. This is happening behind closed doors in widely known unsafe State run and privately sub-contracted facilities and group homes. New York State’s mental health care system as a whole is an absolute disaster, it is extremely dangerous and it is deadly. New York State’s system is rampant with physical and sexual abuse, neglect, and “untimely” deaths which are crimes according to New York State laws, yet most are kept from local police. There are reasons for the staggering numbers of deaths including the fact that almost every imaginable safety and abuse prevention measure that you could think of are still not in place to protect the most vulnerable in New York State. Most parents, family members and legal guardians in most cases have no clue of this. Children and adults with disabilities according to federal law are supposed to be provided safe care that is free from abuse and neglect; yet federal laws are being completely ignored.
Jonathan Carey was developmentally disabled, he had autism, he was non-verbal and Jonathan was diagnosed with PTSD as a direct result from previous child abuse by the hands of many caregivers in a private facility called the Anderson School, now renamed to be called the Anderson Center for Autism. Jonathan was only 13 when he was suffocated to death by a New York State caregiver a few years later at a State facility called OD Heck Developmental Center, as another State caregiver failed to intervene. There was no call to 911; there was no attempt to revive Jonathan immediately. The caregivers drove around town doing errands even stopping at one of their homes before bringing Jonathan’s lifeless body back to the facility approximately an hour and a half later. The attempts to cover up Jonathan’s death by both the caregivers involved and the facility were immediate. Thankfully another young man, Jonathan’s best friend at OD Heck, who was in the van at the same time, who also did what he could to save Jonathan’s life, overcame threats and fear and told the police what really happened and arrests were soon made. As Jonathan’s dad, I can honestly tell you that Jonathan was the most precious and loving person on the planet, no one loved me more. Jonathan made me feel special and important and treated me like royalty. The loss is immeasurable.
It is standard operating procedure in New York State to direct mandated reporters who see and hear crimes occurring against a disabled person to report to Cuomo’s abuse hotline, not to 911 like for anyone else. This is the truth, New York State requires by law that mandated reporters report to themselves with a criminal penalty of a misdemeanor if they do not, but there is no law requiring mandated reporters to immediately and directly report these crimes to 911. Hard to fathom, but in New York State there is no penalty if a mandated reporter does not report a crime, medical emergency or even a death of a disabled person to 911. So a caregiver can walk in on another caregiver raping a disabled child and if they do not report it, there is no criminal penalty, which obviously is insanity. As Jonathan’s dad I have fought for a direct 911 reporting bill for the last 9 years and this year had 70 State legislators sponsoring this vital life saving and discrimination ending bill, but it was negotiated away by the Cuomo administration from ever getting to the floor to be voted on. Bypassing 911 is exactly how most crimes including “untimely” and suspicious deaths are easily covered-up, they are almost always kept from local law enforcement and County elected District Attorney’s. Rarely will these crimes ever see a court room, including almost all premature deaths, many that are manslaughter or criminally negligent homicides, like the men were charged with regarding Jonathan’s death. The key to the cover-ups like for any type of crimes is to keep the information and evidence from ever surfacing and that is what Governor Cuomo’s fraudulent abuse hotline is doing on a regular basis. Almost all reported sexual assaults and deaths numbering in the many thousands annually are never criminally investigated or even reported to County Prosecutors. Most deaths reported to Cuomo’s bogus and fraudulent State hotline never are even reported to County Medical Examiners or Coroners, violating multiple laws. Cuomo’s supposed “Justice Center” was a scheme and a fraud from the beginning; it is primarily a whitewash entity where most criminal cases get buried and disappear. This is happening on a regular basis to protect themselves from justified litigation for the negligent injuries and deaths.

Governor Cuomo and his administration spun a web of lies claiming that he created a new State agency, when in fact he simply renamed and relocated the former Commission on Quality of Care that has decades of history of keeping reported crimes, as well as criminally negligent deaths of individuals with disabilities, from local law enforcement , DA’s and Medical Examiners. The fraud and public corruption is far worse now than ever before and Cuomo’s fraudulent Justice Center is literally and willfully covering up hundreds of times more crimes and deaths. Under the previous name, the State allowed the providers to primarily report to themselves and investigate themselves dealing with hundreds of cases annually. Now under the new name over 7,000 calls are reported to the abuse hotline for the disabled in New York every month on average. The State claims that their highly trained law enforcement officers, less than 30 for the entire State, investigate all allegations of abuse, neglect and misconduct, when in fact most are funned back to the providers where the alleged crimes occurred for internal investigations. As most people know only a fraction of the very dark and ugly crimes happening against the disabled will be ever be witnessed so the absolute rampant abuse and neglect is far worse, it is believed 3-4 times what is reported. Eleven to twelve people are dying on average in New York State’s extremely dangerous mental health care system and many are without question due to abuse or neglect. The sad fact in New York State is that these facilities and group homes were never set up to provide the best of the best care for the disabled and they are unsafe. Instead of treating the disabled as “equal people” New York State has taken the position of who cares if the disabled live or die, we’ll fill the bed with another one on the waiting list. Can you imagine the person directly in charge of this fraudulent State abuse hotline under Governor Cuomo’s direct authority directing State and provider agencies to investigate their own deaths?
