Vancouver Litigation Firm Kushner Law Uses Blog to Dispel Misconceptions around Law and Divorce

Vancouver Litigation Lawyers Kushner Law Release Handy Article to Help People Understand Common Misconceptions Around BC Family Law Act

/EINPresswire.com/ -- VANCOUVER, BC--(Marketwired - November 25, 2015) - Kushner Law Group, a team of litigation lawyers in Vancouver, has released the first article of a two-part series that will help educate people about the Family Law Act (FLA) and how changes in the 2013 legislation may impact separation and divorce. "Although the Family Law Act (FLA) came into effect on March 18, 2013, we find that many people have misconceptions about this relatively new law and how it has changed family law in this province," says the post.

For example, the blog explains that one of the most commonly held beliefs is that BC couples are considered to be common law after six months or one year.

In reality, the new FLA specifically requires couples to be legally married or to have been living together in a marriage-like relationship for two years if they are to be considered spouses. Although many employer-sponsored benefit plans in BC consider partners to be common-law in as little time as six months, the FLA requires a minimum two-year period.

Another popular myth the blog tackles is the idea that couples must be separated and living in physically different homes for one year before getting a divorce.

This myth has been perpetuated because the most common reason used to support a divorce application is that the parties have been living separate and apart for at least one year. Actually, the FLA will consider spouses to be living separate and apart while still under the same roof, provided that there is evidence that one spouse has communicated an intention to separate permanently and that action was taken to demonstrate that intention such as staying in different bedrooms.

"We know that litigation around divorce and separations can be a difficult and emotionally charged time. To streamline the proceedings, we believe it is very important that our clients understand the current legislation, and we will be using our blog as a tool to help meet that initiative."
